Salam orang kampong. Mike jangan buat malu teman...

Bukan nak kata lah yob...teman rasa PRK Bukit Gantang ni bukan laluan mudah bagi YAB Nizar sebenonye.

Kalu sekitar Batu 8, 9 dan 10 serta Changkat Ibol tu oklah...teman tau bebeno le sapa yang sokong PAS dan sapa sokong Umnorumon...

Belah2 sekolah arab tu cuma Wahab anak beranak aje yang sokong Umnorumon...tapi tempat lain tak taulah pulak teman.

Ingat cerite orang rumah teman...tiap kali Pak Long teman panggil ceramah kat depan rumah dia...masa tu jugalah si Wahab ni panggil Umnorumon...buat ceramah jugak. Nak tau rumah dia...tu kat Kedai Fatin yang dah tak beroperasi tu...yang tinggal signboard tu..!!

Nasib baik kawan teman si Buyong tu tak buleh ngundi. Dia kat Kelley Castle. Khabonye dia ngundi kat Liverpool... he he.

Tapi keseluruhannya orang melayu payah berubah yob.


Kalu tengok keputusan PRU12 yang lalu (sila lihat di bawah)...keseluruhannya undi melayu yang pergi kat PR cuma sekitar 40-45% aje. Sedangkan orang cina sudah solid di belakang kita. Harap2 orang indiapun masih istiqamah menyokong PAS.

Calon ke 16 yang tercicir....

Kalu lah tak kerana mesin dialisis jem semalam..dah tentu Pak Usop akan jadi calon favorite kat Bukit Selambau.

Deposit semua dah cukup. Campaign manager dah sampai tapi calon tak muncul....

Dengan lambang mee hon soup...Pak Usop amat yakin akan kasi pukul habis kesemua 15 calon yang lain.

Berbekalkan pengalaman sebagai drebar lokomotif KTM... anak jati Bukit Selambau ini sudah tidak asing kepada penduduk di situ. Malah di mana2 kawasan sepanjang laluan KTM dari Bukit Kayu Hitam hingga ke Woodlands...semua orang kenal Pak Usop.

Seriuosly, di Bukit Indah, Pak Usop terkenal sebagai pejuang PAS yang gigih. Dalam sakit2...beliau gagah bergerak aktif dalam kesemua aktiviti parti. Rutin dialisis seminggu 3 kali tidak mematahkan semangat beliau untuk menegakkan Islam di mukabumi Malaysia ini. Istiqamah dalam perjuangan dan popular di kalangan jemaah.

Sementara itu Pak Wan telahpun menyuarakan hasratnya untuk bertanding di dalam PRU13. Kerusi Parlimen Ampang menjadi idamannya.

"Standard kawe parlimen....DUN tak main lah..!!" Malam tadi dia menyatakan hasratnya kepada teman.

"OK Pak Wan...teman boleh jadi campaign manager.!" Teman memberi semangat.

"MU startlah kutip derma untuk tabung pilihanraya kawe...!" Arahan pertama beliau...

"Apa ni Pak Wan.? YB Khasim dah menang baru mintak derma...Pak Wan belum apa2 dah Kutip... ni berat ni..!!" Ha ha ha....

Alah cian dia!!

Kesian teman tengok Che Det....biasalah orang tua.

Orang tua di hujung2 usia memang macam tu...jadi macam budak2 balik. Hidup ibarat satu putaran roda yob. Teman pun akan jadi macam tu jugak...

Macam budak2...kalu sesuatu yang diminta tak dapat...merajuk dia...begitulah Che Det.

Sehebat mana pun dia...tak dapat lari dia dari sifat2 makhluk yang lemah di sisi Allah...

Mula2 merajuk sebab ANAK BAPAK kalah dalam pertandingan jawatan ketua pemuda...kalah pulak tu pada KJ...ANAK MENANTU...pergh...Tuhan aje yang tahu betapa pedihnya.

Terluah juga dalam tulisan beliau...biar teman ulas satu persatu...

1. Ramai kenalan saya yang fikir saya tidak hadir pembukaan mesyuarat Perhimpunan Agung UMNO kerana anak saya Mukhriz kalah pertandingan Ketua Pemuda.

2. Memanglah saya terasa sedih kerananya.

Ceh...nampak tu. Mula2 Che Det cuba control macho. Dia kata dia cuma sedih...ya lah anak yob. Sapa tak nak tengok anak berjaya walaupun kadang2 kita tau jauh di lubuk hati anak dia tak secerdik mana...he he...!!

3. Tetapi sebab yang sebenar saya tidak hadir ialah oleh kerana Pemuda UMNO secara langsung dan terbuka merestui politik rasuah.

4. Mereka memilih sebagai ketua mereka seorang yang telah didapati bersalah menggunakan wang dan sogokan dalam usahanya untuk dipilih sebagai Ketua Pemuda. Samada dia dibenar bertanding atau tidak, tidak menidakkan dianya adalah perasuah.

5. Hukuman yang dijatuhkan kepada orang ini tidak setimpal dan adil kerana orang lain yang didapati bersalah sama sepertinya tidak dibenar bertanding.

Hmm...tambah lagi marah Che Det kerana pemuda pilih Khairy ghupenye... memanglah Kairy rasuah. Semut dan cicak kat PWTC pun tau...tapi dia menantu PM yob. Najib dan Lembaga kena bagi muka lah kat Pak Lah.

Tak dengo tadi Najib cakap...dia dengan Pak Lah sebenonye adik beradik. Najib is a biological son of Tun Razak...dan Pak Lah pulak Tun Razak punya political son. Tapi lepas ni kita tak tau lah yob...!!

6. Tidak pernah terjadi orang yang dikenali dan diakui umum sebagai perasuah oleh Lembaga Disiplin, oleh parti dan oleh orang ramai dipilih dan dijunjung tinggi sebagai ketua. Tetapi inilah yang dilakukan oleh Pemuda UMNO yang dahulu terkenal sebagai barisan hadapan dalam perjuangan UMNO.

7. Pemuda telah merosakkan imej UMNO dan imej orang Melayu sendiri. Rupa-rupanya duit lebih utama daripada bangsa dan negara. Apakah rakyat akan terima dipimpin oleh tokoh rasuah yang terkenal? Perbuatan merestui rasuah adalah satu pengkhianatan kepada bangsa Melayu dan negara Malaysia.

Oh...ghupe2nye..memang dah macam pre planned lah ye...Lembaga Disiplin pun ada peranan untuk menggerhanakan Khairy with money politic. Nak ban terus tak buleh... kena bagi muka kat Pak Lah...jadi kata Khairy bersalah dan sekaligus mencerahkan peluang ANAK BAPAK.

Tapi lebih malang bagi Che Det...di sebalik skandal Balkis yang didedahkan di dada2 akhbar, ANAK BAPAK masih gagal mengenepikan Khir toyo....seorang lagi calun pemuda yang kelihatannya macam taik. Maknanya ANAK BAPAK lebih teruk dari shit...

Jadi apa lagi...kesimpulan paling mudah ialah dia blame pemuda Umno...tak boleh harap. Kepala shit (sedap sikit bunyi dari kepala ta#k) punya oraganization... tapi kesimpulannya samalah. ANAK BAPAK kalah sebab tu tak datang...

8. Juga saya hairan kenapa untuk mengira hanya 790 undi mengambil masa lebih dari enam jam?

9. Apakah pengira undi tidak tahu kira? Atau apakah sesuatu sudah diusahakan untuk menjayakan menantu Perdana Menteri. Ini menjadi soalan bukan daripada saya seorang tetapi oleh semua orang ramai. Tak usahlah Perdana Menteri bercakap berkenaan dengan menolak rasuah kerana menantu yang perasuah diberi keistimewaan luar biasa.

Teman rasa lah... tak da apa2 konspirasi untuk memenangkan atau mengalahkan sesiapa...

Cuma nya...teman rasa... ini disebabkan pengiraan undi kali ini dibuat di dalam bahasa inggeris.

Memandangkan tukang kira semua lahir dari generasi yang tidak mengamalkan PPSMI...makanya mereka agak sukar mengira undi malam tu. Khabarnya pengiraan dilakukan di dalam bahasa inggeris seperti yang disarankan oleh A. Samad Said. One PLUS two PLUS five...berapa? 100Plus kot? ...

Khabonye jugak kununnye Mat Taib juga menang di dalam jawatan Timbalan Presiden. Tetapi sekali lagi pengiraan dilakukan di dalam bahasa inggeris dan polling agent Mat Taib yang at par inglis nye dengan Mat Taib telah terkeliru dengan angka yang dikira...he he.

Namun petang ini (macam budak2) setelah diberi gula2...datang jugak orang tua tu ke PAU. Sekaligus masuk UMNO dia setelah Pak Lah tak ada...Alah cian dia..!!

Tahniah Najib

Jangan marah teman bila ucap tahniah kat Najib.


Begitu juga...jangan marah teman kalau teman ucap takziah kat Che Det.


Biasalah kalu orang dapat sesuatu yang dihajati...patut sangatlah kita ucapkan tahniah.


Begitu juga kalu ada sesiapa ditimpa kematian atau kesusahan...amatlah wajar kita ucapkan takziah.


(Tahniah Bang Nan kerana dapat menantu..dan tak lupa kepada penganti baru)..


Namun bagi Che Det...tentulah malam tadi ada sedikit kegumbiraan. Cuma bapak Dino aje yang kalah...tapi Zaid Hamidi masih menang yob!!

Kalu semalam kata Mukhriz, "He sounded sad..!" ...mungkin malam tadi boleh tidoq lah kot..?

Kalah menang dalam pertandingan memang adatlah...isk isk..janganlah nangis.

Gi la bisik2 kat Muhyiddin tu...mintak dia sound Najib ambik Mukhriz jadi menteri...

Tak kan macam tu pun teman nak ajor kot?

Peruntukan DIJANGKA akan diluluskan oleh Kerajaan Negeri Selangor dalam masa yang terdekat ini.

Ia bertujuan untuk memperbaiki semua jalan-jalan utama di Ampang Jaya.

Pada teman...sewajarnya kerja-kerja pembaikan ini dilakukan ke semua pelusuk Ampang Jaya. Teruk bebeno jalan2 di sini.

Kereta teman dah berapa kali sewel alignmentnya sebab masuk lubang sana lubang sini.

Setakat ini kerja yang dilakukan ialah kerha tampal menampal sana sikit sini sikit aje. Ini semua kerja penghabih bogheh jo...

Harap2 dengan peruntukan sebegini MPAJ boleh buat kerja dengan lebih baik. Ada perancangan dan diikuti dengan execution yang ikut spesifikasi. Pastikan tiada leakage ya....

Orang Umno: Berubah Atau Rebah?

Orang Umno kan pemalas...

Dahlah pemalas nak kaya cepat pulak tu...

Sebab nak kaya cepatlah dia orang masuk Umno...

Kalau dia nak kaya dan kena kerja kuat...orang tak masuk Umno...

Tak masuk apa-apa parti pun...asalkan bersedia untuk kerja kuat dan ada sedikit akal...boleh kaya jugak...

Tiba2 dengan malas2 boleh jadi kaya...Najib suruh berubah.

Najib suruh orang Umno jadi rajin...suruh orang Umno kena kerja kuat macam orang lain...kena bersaing dengan orang lain...mahu ke dia?

Najib suruh orang Umno berhenti terima rasuah...pendek kata dalam pemilihan Umno ke Pilihanraya ke...kira2 tak ada upah...tak ada hadiah...tak ada duit saku...mahu ke dia?

Teman boleh kerat jari lah yob. Kalu tak ada fulus...satu posterpun tak naik. Tak ingat PRU12 di Bukit Indah dulu. ?

JADI yang paling mudah ialah option kedua yang Najib bagi....REBAH. Tak payah buat apa2... teruskan macam biasa. Harta rakyat jadi macam harta mak bapak dia...Ikut Suka Aku... biasiswa untuk orang Umno. AUKU...Aku Janji..PPSMI...fitnah..penjara..liwat... buatlah apa2 yang patut.

Teman gerenti REBAH punya. Tak payah berubah yob.

Surat Perjanjian Beli Berus Gigi...

Teman macam tak percaya malam tadi. Anak teman yang kecik sekali tu (baru 6 tahun)... terjerit2 panggil teman...

"Ayahhhh...naik atas sekarang..!" Jerit minah ni.

"OK boss!" Meluru teman menyusuri tangga...

"Ha kenapa....?" Tanya teman.

"Ayah sign sini...ini surat perjanjian. Ayah mesti tepati!!" Aik budak 6 tahun dah suruh teman sign agreement.

"Perjanjian apa ni?" Teman kehairanan dan terkejut...

"Malam esok ayah mesti belikan berus gigi untuk Iman.! Tengok belakang dan tandatangan kat bawah!!" Macam lawyer S&P aje budak ni.

Ini semua gara2 teman beli berus gigi untuk teman dan orang rumah. Lupa pulak nak beli untuk si kecik ni...

Hmmm...sampai kena sign surat perjanjian pulak. Setahu teman 99% dari apa yang teman janji semua dah ditunaikan.

"Ada satu lagi ayah tak tunaikan janji...kata nak bawak Iman main bowling!!" Alamak terkena teman.

"Itulah sebabnya ayah kena sign surat ni...!" Hmm...satu punya hal budak ni dah tak percaya kat teman...

Agaknye budak nipun mengikuti kemelut krisis di Perak kot? Apa idaknye...mak bapak dia dok cerita pasal Perak tak habis2. Budak kecik pun tau undang2 la ni ye...

Sayangnya orang tua2 yang tak tau undang2...lebih menyedihkan situasinya seperti harapkan pagar...pagar makan padi. Macam mana Mahkamah Tinggi boleh merujuk kes ini ke Mahkamah Persekutuan secara teruspun teman tak faham... Dah lah tu...dah jadi macam precedent case pulak... Mahkamah Tinggi Ipohpun mengambil jalan yang serupa.

The Federal Court has sent a lawsuit filed by Pakatan Rakyat Menteri Besar Nizar Jamaluddin challenging the legitimacy of his rival Zambry Kadir’s appointment back to the Kuala Lumpur High Court for hearing.

Chaired by Court of Appeal president Alauddin Sherif, the five-member bench ruled that Justice Lau Bee Lan had no power to refer state constitutional questions under Section 84 of the Courts Of Judicature Act, as the word constitution therein is limited to the Federal Constitution.

Nizar’s lead counsel Sulaiman Abdullah had this morning raised the preliminary objection. The High Court is now expected to hear the case either this week or next week.

He said he never paid her casual visits.

Paari, 46, also admitted that Sujatha had visited him at home on numerous occasions and both of them had gone out for dinners.

“Sujatha had accompanied me for official and family functions,” he said.

Paari also said he paid RM220,000 in cash for the condominium unit where Sujatha had stayed and stood as a guarantor for a bank loan amounting to RM200,000.

Brunei denies Sarawak border dispute resolved
BANDAR SERI BEGAWAN, March 19 — Brunei has denied claims that the sultanate and Malaysia had resolved their territorial dispute over Limbang in Sarawak.


Brunei's Second Minister for Foreign Affairs and Trade, Pehin Dato Lim Jock Seng, on Tuesday set the record straight by denying there was any discussion on Limbang during talks on Monday between Malaysian Prime Minister Datuk Seri Abdullah Ahmad Badawi and Sultan Hassanal Bolkiah, the Borneo Bulletin reported yesterday.

“In actual fact, the claim on Limbang was never discussed. What was discussed was the demarcation of land boundaries on the whole,” Lim said in response to a question at the Legislative Council session.

He said a joint press statement issued on Tuesday mentioned that the demarcation of the land boundaries would be resolved on the basis of five existing historical agreements between Brunei and Sarawak.

“After that, a working group comprising general surveyors of the two countries will follow with the technical aspect to solve the land border issue.''

Malaysian media had widely reported Abdullah as saying that Brunei had dropped its claim on Limbang. The Limbang dispute can be traced back to the cession of the territory by Brunei to Sarawak's White Rajahs in 1890. The cession had been strongly disputed by the sultanate, which regarded the transfer as annexation by Sarawak.

The move had resulted in a significant reduction of Brunei's territory and cut the sultanate into two. — The Straits Times

Seriously...buat apalah ada Jawatankuasa Disiplin kalu setiap keputusannya sering dipertikaikan? Dalam kes Ali Rustam ni teman lihat selective prosecution lebih mendetail lagi...undang2 ke disiplin ke untuk team Pak Lah aje. Team Pak Lah kena ikut undang2....team Najib ok aje. Mike percaya ke team Najib tu bersih semuanya? Ha!! Padanlah muka. Selama ni buat kat orang lain bukan main lagi.

Mat Taib tak kena sebab dia pada mulanya tak jadi ancaman kepada sesiapa. Mengikut tinjauan UM...dia cuma dapat 10% aje. Ali dapat 55% dan Muhyiddin dapat 35%. Jadi sasarannya Ali lah. Dia lupa (macam dia lupa beli speaker Perak) bila Ali kena...sokongan kepada Mat Taib secara otomatik bertambah. Budak2 Ali semua pakat sokong Mat Taib. Ha...! Lepas ni jagalah kau Mat Taib.

Teman menjangkakan...kalu pun Mat Taib menang...lepas pemilihan ni akan adalah yang nak pekenakan Mat Taib. Bakal jadi Isa Samad lah mike yob!!

Tapi apalah nak dihairankan...Itulah budaya Umno.

Zaid urges King not to make Najib PM
KUALA LUMPUR, March 18 - Datuk Zaid Ibrahim has made an impassioned plea to the King to not appoint Datuk Seri Najib Razak as prime minister, and instead appoint someone else from Umno "to bring us back from the brink."

The former de facto law minister urged the King to used his judgment to appoint as PM someone who is "beyond reproach in his dealings both official and private," in a scathing attack on his former Cabinet and party colleague.

"A prime minister must have the confidence of the majority of the rakyat…For this to be the case there cannot be anything in the mind of the greater public that, correctly or otherwise, associates him with matters of criminality, wrongful action, improper conduct or abuses of power," he said in a speech to the Rotary Club here today.

Zaid's remarks will certainly put pressure on Najib as he prepares to take power first as Umno president next week before taking over from Datuk Seri Abdullah Badawi as prime minister the following week.

The former minister's comments also come a day after Tun Dr Mahathir Mohamad also piled on the pressure on Najib by saying he did not shine as a deputy prime minister and acknowledging the baggage he carries into the job.

In his speech, Zaid also made reference to what has been described as the kind of baggage that no other Malaysian leader had on entering office.

He has been linked on the internet and by political rivals to the brutal murder of Altantuya Shaariibuu although he has firmly denied involvement and there is no evidence to tie him to the death.

Najib's popularity rating also stands at just 41 per cent, according to a recent poll by the independent Merdeka Centre.

Zaid said that while he did not intend any accusation, he felt that Najib was not beyond reproach in the collective mind of the rakyat.

"The rakyat has doubts, fuelled by the unanswered allegations against him. It is not a mere trifle in the minds of the rakyat that despite a direct challenge from a member of parliament recently, the deputy prime minister remained silent," he said.

Zaid also cited the RM400 million in commissions reportedly paid by the Defence Ministry while Najib was minister for the procurement of submarines, and pointed out that Abdul Razak Baginda, the DPM's friend was an agent in the deal.

The Altantuya murder was also cited by Zaid, who pointed out that there were many unanswered questions which the public deserved to be told about.

He also described the recent power grab in Perak as an unmitigated disaster.

"They (the public) now equate him with the high-handed tactics that were employed to seize power.

"With all of this and more, how are we not to feel anxious? How are we to sleep peacefully at night?"

Zaid said that while the King is required under the Constitution to appoint the person who commands the confidence of the majority of the members of parliament, it is a matter for His Majesty's judgment.

"There is no constitutional obligation on His Majesty to appoint the president of Umno as the prime minister.

"There are still well qualified members of parliament from Umno who can be appointed PM to bring us back from the brink."

Way cleared for Muhyiddin


Muhyiddin set to become the deputy president of Umno and deputy prime minister of Malaysia.

KUALA LUMPUR, March 17 - The path will be clear today for Tan Sri Muhyiddin Yassin to become the deputy president of Umno and deputy prime minister of Malaysia - but expect acrimony and ill-feeling to reign in the ruling party.

The outcome for the number two spot in Umno will be guaranteed today after Malacca chief minister Datuk Mohd Ali Rustam opts out from contesting for the number two position in the party or is suspended from Umno.

Sources told The Malaysian Insider that the party's top leadership has given the politician an option: withdraw from the race or face possible sanctions from Umno disciplinary committee.
Ali is among several senior politicians investigated for money politics in the run-up to next month's party elections.

Hugely popular with the grassroots, he was expected to snare enough votes from Umno delegates to win the coveted deputy president's position, beating Muhyiddin and Tan Sri Muhammad Muhammad Taib to the finish line.

This prospect unnerved powerful forces within the ruling party who felt that he did not have the stature or the tools (notably a poor command of English) to become the DPM to Datuk Seri Najib Tun Razak.

They also felt that he was too close to Prime Minister Datuk Seri Abdullah Ahmad Badawi, a politician they blamed for the loss of five states and the two-thirds majority in Parliament in Election 2008.

Over the last few weeks there has been a campaign of agitation by this group of party officials for action to be taken against several individuals not "sanctioned'' by them.

Ali's supporters charge that there are several hidden hands behind the move to take the Malacca CM out of the race, a few of them linked to the Umno disciplinary committee or with some influence on the members of the committee.

They argue that every candidate contesting the party elections has paid "petrol money'' of a few hundred ringgit to delegates but only a clutch have been given show cause letters.

Their grouse: there appears to be selective prosecution by Umno's disciplinary committee, aimed at clearing the way for certain individuals to emerge victorious at the party polls.

They refuse to accept that the committee reached its decision to take action based on conclusive evidence or good faith.

Ali Rustam and others face polls shutout?

KUALA LUMPUR, March 16 — Speculation is rife tonight about the possibility that a number of top Umno leaders, including leading deputy presidential candidate Datuk Mohd Ali Rustam, face suspension from the party for breaking campaign rules.

Umno could enter a period of uncertainty tomorrow if the party’s disciplinary committee takes action against these top leaders, as expected.

The Malaysian Insider has learnt that several candidates have received show cause letters in relation to allegations of money politics.

Umno disciplinary committee chairman Tengku Ahmad Rithaudeen Ismail will hold a press conference at 4pm tomorrow where an announcement will be made on the matter. But this evening threats were already flying with supporters of senior party officials promising reprisals if their benefactors are found guilty of money politics by the disciplinary committee.

A party official, who requested anonymity, told The Malaysian Insider: “There is a lot of restlessness in the party.

“The disciplinary committee is set to make a few announcements tomorrow. If there is a sense that it is to clear the way for certain individuals then there will be problems.”

Besides Mohd Ali, a number of other candidates are also facing the possibility of being blocked from contesting the crucial party polls next week.

Among them are deputy Umno Youth chief Khairy Jamaluddin, former Selangor mentri besar Datuk Seri Dr Khir Toyo, Tan Sri Muhammad Muhammad Taib, Datuk Seri Azalina Othman and Datuk Norza Zakaria.

If any of these leaders are blocked from contesting in the elections, it will send shockwaves through Malaysia’s biggest political party.

Mohd Ali, the Malacca chief minister, is said to be leading in the race to become party deputy president.

If he is disqualified, it will virtually mean the deputy presidency will be delivered to Tan Sri Muhyiddin Yassin.

The other contender for the party No 2 post is Muhammad who is said to be lying a distant third in the contest.

Dr Khir has already stated that there are attempts being made by unnamed quarters to sabotage his and Mohd Ali’s campaigns.

The Selangor Opposition Leader is leading the race to become Umno Youth chief.

But if he or Khairy are suspended, the remaining contender, Mukhriz Mahathir, will win in a walkover.

Norza, who is defending his party supreme council seat, has already been charged in court for bribery in his campaign, and is almost certain to be suspended or even expelled.

Azalina, who is also contesting a supreme council post, is being investigated by the Malaysian Anti-Corruption Commission (MACC). Her political secretary was also recently detained for questioning.

A mass suspension or expulsion of leaders suspected of corruption or vote-buying could have unpredictable results on the party.

While public support may be gained from tough action, a full scale shutout of candidates from key posts such as the deputy presidency could lead to accusations from within Umno of favouritism by Datuk Seri Najib Razak.

Ipoh council serves notice to a tree
IPOH, March 14 — The Ipoh City Council has now taken its turn to fuss over Perak’s democracy plaque, claiming that the structure was an obstruction in a public area.

The council pinned a notice on the “Democracy Tree” late yesterday evening, informing the “owner” of the plaque to remove the monument within 24 hours before it gets destroyed.

Pakatan Rakyat has chosen to laugh at the council’s method of serving the notice to the tree instead of to an individual however, and said that it would ignore the notice.

“None of us, not one person from any PR party, received the notice.

“The notice was addressed to the owner of the plaque and yet the council served it to the tree, as if the tree owns the plaque.

“In that case, I guess they expect the tree to take heed of their notice and destroy the plaque,” joked Perak DAP secretary Nga Kor Ming to reporters at a press conference today.

He said since no such notice had been given to any of the PR parties, nothing would be done about the plaque.

The notice claimed that the plaque, erected on a road reserve, was illegal because PR had not applied for a permit from the council.

It also said that the structure posed an obstruction to the public and hence contravened Section 46(1)(a) of the Road, Drainage and Building Ordinance 1974.

“It is true that we have to obtain permission from the council but since the council is now run by the Barisan Nasional, it is pointless for us to apply for such a permit,” said Nga.

He added that sources in the council had already informed him that the PR did not stand a chance of obtaining the permit.

“If they destroy the plaque, we will simply build a new one.

“In fact, if they destroy one, we will build two. If they destroy two, we will build four. They cannot stand in our way,” he said.

Meanwhile, earlier today a delegation of Cheras PKR division members paid a visit to the democracy tree.

The division’s Wanita wing contributed RM500 to the democracy plaque building fund and another RM500 to the Bukit Gantang election machinery.

KUALA LUMPUR, March 14 — More than a month after Barisan Nasional ousted Pakatan Rakyat from Perak, former Prime Minister Tun Dr Mahathir Mohamad today said the takeover was not done according to the law.

He said mistakes, bad strategy and carelessness in the Feb 5 power grab, orchestrated by Deputy Prime Minister Datuk Seri Najib Razak, had led to the current crisis in the state.
"You cannot topple a menteri besar or a prime minister without a no-confidence vote in the assembly. There is no other provision," he said at a function organised by Mubarak, the association for former elected representatives.

"Umno-BN was too careless and did not wait for an assembly but instead asked the Ruler to sack the menteri besar," he said, referring to Sultan Azlan Shah's decision to ask Datuk Seri Nizar Jamaluddin to resign.

"As far as I know, there is no such provision in the Perak or Federal Constitution," he said.
Dr Mahathir said that BN should have done it properly and not "be in conflict with the law" as the courts may now rule that the Sultan has no right to sack a menteri besar.

He added that a Sultan could only reject a candidate for one of his choice after an election but even this candidate could be defeated in the assembly by a vote.

The veteran politician said BN should have "followed the laws of the country, especially the constitution."

"Because this may be in conflict with the law, we find that people will not comply. Because we started on the wrong foot, people are now against us," said Dr Mahathir, who quit Umno last year in a long-running feud with his successor Datuk Seri Abdullah Ahmad Badawi.

The Perak power grab is now mired in a series of lawsuits, with both sides claiming to be the legitimate government.

Six people have also been charged with insulting the Perak Ruler after he backed BN to govern the state. One has pleaded guilty and was fined RM10,000 yesterday while five others claimed trial.

Umno has said those who opposed the Sultan's decision are committing treason.

Itu pertanyaan oleh salah seorang hakim Mahkamah Rayuan kepada Perak SLA, Ahmad Kamal sebelum memutuskan yang Sivakumar boleh diwakili oleh peguam persendirian.

Kan dah sewel jadinye...Persoalan ini adalah persoalan asas mana2 budak tahun satu jurusan undang2 pun tau jawapannya...Nak belit sana sini tu buat apalah?

Dr Zambry’s counsel Syed Faisal Syed Abdullah argued that Sivakumar was drawing his salary from the consolidated fund of the state government, thus making him a public servant of the state.

Counsel Tommy Thomas, for Sivakumar, said: “The Yang Di-Pertuan Agong and the Sultan are paid by consolidated funds but by no stretch of imagination can you describe them coming under the Government Proceedings Act.”

The Court of Appeal said there “is no provision in any law that the Speaker must be represented by the state legal adviser. (He) is not a state officer or a government of the state under Section 24(3) of the Government Proceedings Act, 1956.”

"We uphold that the Speaker is at liberty to engage his own private advocate and solicitor,” said Justice Md Raus Sharif who sat with Justices Abdull Hamid Embong and Ahmad Ma’arop.

The ruling overturned the decision made by Judicial Commissioner Ridwan Ibrahim on March 3, 5, and 11, who insisted that Sivakumar can only be represented by the Perak state legal adviser.

Tuduhan Gobind Singh Deo Di Parlimen Serius...

Teman petik ini dari Harakah Daily....Najib dituduh pembunuh di Dewan Rakyat...

Betul tak betul kita tak tau...tapi tuduhan sebegini di dalam Parlimen tidak boleh dipandang ringan.

Teman tak berapa setuju dengan TGNA...Najib perlu selesai politik Perak sebelum ajak Pakatan pulih ekonomi...

Bagi teman tuduhan Gobind adalah lebih serius jika dibandingkan dengan kes Perak. Lagipun bagi kes Perak, Sultan Perak boleh settle kan sendiri tanpa Najib...kalau baginda ada kemahuan.

Menuduh Najib tanpa memberi peluang kepada beliau menjawab dalam forum yang betul.. tentulah tidak adil dan jahat.

Ramai orang yang menulis tentang kes Altantuya ini. Dari RPK sampai ke Perancis. Rasanya selagi Najib tak dibawa ke mahkamah untuk memberi keterangan...tak habis cerita ni. Macam2 cerita di luar sana...tak tau mana satu nak kita dengar.

Banyak sangat persepsi buruk rakyat terhadap Najib. Kita tak perlu kepada sumpah sumpit beliau. Yang wajib dilakukannya ialah jawab tuduhan Gobind...samada di Parlimen atau di mahkamah.

Otherwise, rasanya Mat Taib lebih layak jadi PM. Sekuarang2nya dia cuma kawin lari dengan anak raja saja. Selepas 6 tahun PPSMI dilaksanakan...tak kan Mat Taib masih tak buleh spik inglish kot?

Khir Toyo blows up over claims wife given Rover

SHAH ALAM, March 12 — Threats and curses were allegedly uttered at the lobby of the State Assembly here by Opposition Leader Datuk Seri Dr Mohd Khir Toyo, after it was disclosed during proceedings that his wife had been given a RM500,000 Range Rover by a state subsidiary during his administration.

Ulu Kelang Assemblyman Saari Sungib alleged that Dr Mohd Khir had told him to “watch out” as they were leaving the assembly to break for lunch.

“Khir accused me of attacking his wife in the assembly, adding that he would never forgive me and will seek vengeance till the end of time if his wife, Datin Zaharah Kechik miscarried.”
Saari said he told the former menteri besar, who also denied his wife had ever driven the Range Rover, that he was not attacking his wife but was merely asking the state to investigate his claims.

Saari said Dr Mohd Khir looked serious when he made the threats, which he claimed was heard by other assemblymen.

Earlier while debating the Royal Address, Shaari alleged that the Range Rover was purchased by development company Syarikat Cekal Tulen, a subsidiary of Kumpulan Darul Ehsan Berhad.

He said the justification for the purchase was the company needed a robust vehicle for executives to make site visits, but the car was handed over to the wife of the KDEB chairman to use.

“The company had claimed they needed a robust vehicle and the state should investigate the matter.”

Saari also disclosed that Kumpulan Darul Ehsan Berhad (KDEB) had attempted to purchase two luxury cars, worth RM2.5 million early last year.

One of the cars was a Mercedes S500 meant for the KDEB chairman Khir, worth RM1.5 million while the other was a Mercedes S350, which cost almost RM1 million for the KDEB president.

Saari said RM1 million or 40 per cent of the price was paid to a salesman from Cycle and Carriage as down payment, but the cars were never delivered after March 8, when Selangor fell to Pakatan Rakyat.

“As far as I know, the money was also never returned to the state.”

He also said that KDEB had made an unauthorised purchase of two apartments at the Al Marwa Towers, in Saudi Arabia.

According to him the KDEB chairman had issued a personal cheque for RM800,000 as down payment for the two apartments, while in Saudi Arabia, before calling the subsidiary to sanction the purchases.

“The decision to make the purchases were made in Saudi Arabia, not by the board here and the move may be contrary to corporate governance practices.”

Previously it was reported that state investment agency Permodalan Negeri Selangor Berhad (PNSB) had also made unauthorised investments in Mecca, Saudi Arabia.

A total of RM25.6 million was spent by PNSB to acquire 12 units of apartments at the Al Marwa towers.

Saari said the two cases were interrelated and urged the state government to probe the matters.
Officials for the state, today, said officials from KNEB are being queried on all the allegations.


Menteri Monopause

Pukul 9 teman ada appointment lain kat bangunan sebelah tu. Kali ni dengan kawan sekolah di STK. Dia jadi CEO sebuah agensi kerajaan. Tak sangka budak Simpang Rengam Pineapple Estate boleh jadi CEO. Ada drebar..ada PA. Semua ada. Bilik dia besornya 10 kali bilik teman. Hebat. Teman tumpang rasa bangga.


"Yob...mike ada tanah 2,500 hektar?" Kawan teman tu buat lawak pagi2 bute...


"Estate tempat mike terkucil tu pun tak sebeso tu!" Jawab teman selamba sambil menyelak kertas2 kabo kat settee yang canggih tu..


"Apa ke hei?" Teman curious...


"Kalu mike ada tanah sebeso tu...teman boleh tolong bagi loan. RM5,000 satu hektar. Lepas 16 tahun baru bayar. Interest 3% setahun...Itupun lepas 16 tahun baru start bayar." Panjang penerangan kawan teman tu...


"Mak oi...! Teman ada 5 ekar kat Changkat Jering. Berapa loan mike boleh bagi?" Saja teman tanya...


"Satu kupangpun teman tak boleh nak bagi....mike tanam pokok gaharu ajelah. Lepas 7-8 tahun mike boleh dapat RM1.8 million se hektar. Itupun kena tanah yang terrain dia sedikit berbukit. Sebab pokok gaharu tak buleh tanam atas tanah yang takong air...!" ... Syarah kawan teman tu lagi..


"Hmm banyak tak buleh dari buleh ni yob? Apa punya polisi kerajaan kita ni? Yang kaya lebih kaya yang miskin bior melarat aje?" Teman berleter...


"Apa nak buat yob...! Ini bukan polisi teman...ini polisi kerajaan..!" Tersengih aje kawan teman tu...


Setengah jam kemudian kawan teman sorang lagi datang. Dia ni pun dulu satu sekolah jugak. Bekas pegawai tentera yang banyak berjasa menaikkan nama negara dan perjuangan Islam. 28 tahun kawan ni tak jumpa kawan teman yang sorang lagi tu.


Seronok sungguh bila jumpa kawan2 lama.


Kedua2 kawan teman ni otak biz belaka.


"Bro...teman dulu pernah buat proposal kat Kementerian Pelajaran. "Education On Wheel'. Satu2nya negara yang ada benda ni ialah US. Dalam negara Islam kalu proposal teman diterima ianya adalah yang pertama. Tapi malangnya... despite semua orang Kementerian Pelajaran prefer proposal teman...dema semua tu terpaksa terima Hishamduddin punya proposal. Dia menteri..teman ni siapa?" Sungut kawan teman tu...


"Apa menatang Education On Wheel tu?" Teman tercengang2.


" OK...apa menatang Projek Formula 1 Hishamuddin tu? Ada nampak apa2 kesan kat sekolah sekarang ni? RM300 million hilang melayang yob?" Kawan teman tu tembak teman balik...


"OK..education on wheel tu macam gini. Kalu anak mike atau anak2 sapapunlah...dia ada cita2 nak jadi doktor umpamanya...Kita sediakan kesemua peralatan kedoktoran di dalam bas. Bas ni canggihlah yob...bukan macam bas Metro atau Rapid. Pendek kata semua medical equipments yang penting2 ada termasuk operation theater etc. Jadi budak2 boleh menanam dan memupuk minat mereka dari awal lagi. Bagi budak yang brilliant... umur 15 tahun dah boleh masuk U ambik medic macam anak teman. Tak payah bawak beg berat2 macam mike complaint hari tu...!!" Wow hebat idea kawan teman ni.

"Bas ini boleh bergerak dari sekolah ke sekolah. Kesemua equipmentnya real bro...patung untuk dibedahpun boleh keluar darah + organ dalaman etc. Itu kalu profession doktor. Kalu nak jadi pilot kita sediakan peralatan untuk jadi pilot. Cockpit, stimulator dll. Pendek kata semua latihan seperti Steep Turns, Stalls, Minimum Controllable Airspeed or MCA, Vmc Demonstration, Drag Demonstration, Single Engine Operations with "Feather and Secure", Emergency Operations, Normal and short Field Takeoffs and Landings boleh dilakukan di dalam bas tu.." Lagi pening teman.


"Berapa kos satu bas yob?" Kawan teman yang sorang lagi bertanya...

"RM 5 juta! 10 bas baru RM 50 juta.! Projek Hishamuddin RM300 juta. Sampai la ni tak tau apa jadi dengan projek Formula 1 tu. Projek bodoh. Projek bodek sambil buat duit. Tak ada faedah langsung untuk Malaysia.!" Bengang betul kawan teman tu.

"Hmm...selama jadi Menteri Pelajaran apa dia buat? Satu hapahpun tak boleh pakai. Ada cita2 nak jadi PM pulak tu. Asyik guna nama mak bapak aje..!" Teman saja api2kan.

So yob...mike boleh tak tolong jumpakan teman dengan Pak Lah...? Teman nak convince Pak Lah sebelum dia berhenti ni...tinggalkanlah sesuatu untuk rakyat Malaysia!!" Kawan teman tu dok tanya kawan yang CEO tu..

"Tunggu Najib take overlah yob. Pak Lah tu la ni macam perempuan dah monopause. Khairypun dah tak dengo cakap dia!!" Mudah aje jawab mamat tu...

Tak habis dengan kisah ke Tokyo dan ke Hong Kong...hari ini gundah gulana si KT gara2

Pak Kadok Vs Pak Pandir

Arakian maka kecohlah se antero Malaysia bila mendengar kisah lelucu yang dinukilkan oleh Raja Nazrin tentang kebodohan Pak Kaduk.

Maka ramai bebeno peempunya blog yang bagi komen.

Antaranya di sini..Raja Nazrin dan Pak Kadok dan Raden Jowo dan Hikayat Pak Kadok dan Sultan Perak... Betul tak betul cerita dema teman tak tau.

Maka tiadalah niat teman untuk menjadi nasi tambah di pagi yang hening ini.

Hanya sekadar nak petik satu cerita rakan Pak Kadok...Pak Pandir namanye.

Nak dijadikan cerita, pada zaman dahulu, ada seorang lelaki bernama Pak Pandir yang tinggal di hulu sungai di sebuah kampung. Nak dijadikan kisah lagi, tinggallah seorang polis berjiran dengannya. Pada petang yang hening itu, berjalanlah Pak Pandir ke kedai untuk membeli kelambu kerana rumahnya terlalu banyak nyamuk. Sekembalinya dari kedai, dipasangnyalah kelambu itu pada katil bagi melindungi dirinya dari nyamuk.

Pada malam itu, datanglah polis si jiran tersebut ke rumah Pak Pandir untuk berborak-borak. Dicari-carinya Pak Pandir tetapi tidak berjumpa. Akhirnya keluarlah Pak Pandir dari bawah katil. Terkejut si polis kerana Pak Pandir tidur kat bawah katil sedangkan di katilnya ada kelambu. Bertanyalah si polis,

Polis: Awatnya tidoq bawah katil?
Pak Pandir: Saja....nak tipu nyamuk.

Alahai negeri pasir berdengung...

Ditelan mati emak...diluah mati bapak!!

Che Det dah janji kat teman..."Chek jangan bimbang na...saya akan dedahkan nama calon2 Umno yang rasuah kalu BPR (SPRM) dan Umno tak buat apa2. Saya ada bukti...!!"

Ini semua masa dia tengok pencalunan KJ dan KT tiba2 meningkat... Begitu juga pencalunan AR dan MTpun jadi banyak secara tiba2.

La ni apa jadi?


Bisinglah dia sana sikit sini sikit. Nak buat apapun tak bulihlah kot..bak kata Nizar..."ditelan mati emak diluah mampuih bapak..!!

Menurut kajian UM...la ni Lee Ketam tengah leading...53% katanya. Begitu jugak KJ tengah di depan...

Che Det ooi...Tak guna Najib menang tapi Lee Ketampun menang jugak...

Apa lagi Che Det...hurry up yob...!! He he..

Umno menggali kubur sendiri...

Sepanjang minggu lalu banyak peristiwa yang berlaku.

Dari demokrasi yang nazak di Perak sehinggalah kes Anwar yang mula di'hijack' ke Mahkamah Tinggi.

Kemuncaknya Apai, Anas, Mee Panjang, Shukri, Radhi dll dibedil di Masjid Negara... gara2 sokongan mereka nak menghapuskan PPSMI.

Cerita Umno menggunakan instruments kerajaan untuk survival mereka bukanlah satu cerita baru. Namun akhir2 ini Umno mencipta rekodnya yang tersendiri apabila ketiga2 badan dalam pemerintahan negara yang sepatutnya bebas antara satu dengan yang lain telah digunakan serentak. Masing2 dengan darjah perlanggaran prinsip masing2. It was a blatant disregard for the democratic principles.

Ia adalah penyakit parti-parti tua. Baik Golkar di Indonesia, LDP di Jepun, INC di India dll telah menempuh 'stroke' dan maut di negara masing2. Samada natural death atau mati accident... Umno pasti mati.

Rakyat seperti teman melihat ini semua tercengang2 dan merenung nasib negara. Apakah ada masa depan demokrasi di negara ini? Apa sudah jadi dengan 2 prinsip rukun negara yang amat penting itu?

1. Keluhuran Perlembagaan
2. Kedaulatan Undang-undang

Kalau semua cabang pemerintahan negara secara sukarela boleh digula2kan dan menjadi alat kepada Umno...tak ada banyak yang boleh kita lakukan. Bagi teman...kita hanya menanti PRU13 untuk memulihkan semuanya. Lagi cepat ia datang lagi baguslah untuk Malaysia.

Tulisan2 dari kolumnis beberapa akhbar hari ini banyak menulis tentang Umno yang sedang meniti garis2 akhir hayatnya kerana kedegilan dan ketidakupayaan mereka untuk membetulkan diri mereka sendiri. Baca ini..A desperate need for change dan ini...One year on, the BN still has no answer...

Suka atau tidak...sebenarnya, (krisis negeri Perak) adalah manifestasi Umno sedang menggali kuburnya sendiri.!!

Diterima Oleh Masyarakat Bukan Islam: Apa PAS Perlu Lakukan Sekarang?

Teman amat tertarik dengan respond pembaca2 kepada satu artikel yang disiarkan oleh The Malaysian Insider tulisan Adib Zalkapli. Teman link kan artikel tersebut. Ada satu dua pandangan yang agak sceptical tetapi keseluruhannya positif.


Krisis Perak, walaupun terasa peritnya...namun ada hikmah di sebaliknya. Keupayaan Nizar menerajui Perak lebih 10 bulan, kebolehannya menangani krisis serta ketrampilannya dengan imej yang amat menyegarkan telah membuka mata DAP dan masyarakat bukan islam keseluruhannya terhadap PAS.


Teman berpeluang mengikuti ucapan Nizar di Subang baru2 ini (terima kasih Anas) dan teman betul2 impress dengan kecerdikan dan kebolehan beliau yang sebelum PRU12 tak pernah teman dengar namanya. Mungkin di luar sana...ramai lagi yang menunggu untuk diberi peluang.


Sudah sampai masanya the second echelon diberikan peluang untuk lebih ke depan dalam usaha mengubah persepsi seluruh rakyat Malaysia terhadap PAS. Ini tidak bermakna kita membelakangkan TGHA dan TGNA dan kepimpinan sedia ada tetapi greater role perlu digarap dari pemimpin pelapis seperti Nizar.

Mungkinkah usaha untuk rebranding PAS seperti yang diwar2kan oleh Ustaz Nasa selepas PRU11 2004 telah mula membuahkan hasil. Makanya usaha yang lebih giat mestilah diteruskan.

Dalam menggamit kejayaan kita janganlah lalai atau riak hingga akhirnya kita tenggelam dalam arus yang tidak pernah kita tempuh ini.

Proper governance of a state or country should not be mixed with religious governance. Religious values should be used to guide the state and country governance instead. After all all religions have admirable values and they are all consistent except for BN with their governance based on corruption, rampant theft of country's assets, barbaric treatment of those who go against them and to propagate their existence. Down with BN.

Islam as all religions worthy of respect has its roots in truth. However, what PAS interprets Islam as, has never intimidated the non_Muslims. Infact, history records Islam as a respecter who sanctioned freedom of religious practice, but historians have deliberately twisted and maligned this way of life. I am a non-Muslim but I tend to understand the wonderful similarity in this religion to that of the spiritual aspects of my own religious faith. I must give credit to this non-pretentious approach that Tuan Guru Nik Aziz has accorded to us non Muslims to understand and love Islam.

Tok Guru is a true muslim who treats all races as a single human race. He is fair and knowlegeable about Islam. Though there are a few who are fanatical, they are not hypocrites and can be brought back to the right path. On the other hand, XMNO goons are lunatic fringe who do nothing right except wrong, in the eye of Islam. Some of these XMNO goons would practise "Hadhari" --- ie. HAD pada waktu HARI siang, but at night they become monsters and do everything, while the rest of the goons commit sins day and night. PAS has not endeared non-muslims but also muslims. Kelantan is the best example.

PAS is PAS, it is different from Umno, big different. I used to listen and read the Main Stream Media, however, now after being visited Kelantan, and talk to the Kelantan folks, they are giving very good feedback about PAS, not that they are perfect, but rather, PAS is a principle based party, they are so much better with integrity, as compared to the normal Umno. There is a big different, they are following the priciple and look at them, they are less corruption in PAS, they are not perfect, but they are with integrity, which is predictable, very hard to find. Not like Umno, it is usuallly corruption and power, any which way that work, not priciple base. that is dangerous. Similarly, if people pay you money, you can cross over, that is just like prostitute, got money can go to bed, no need love. We must make sure Tok Guru, the way of life, their body language, their way of life that is different, samething, we can see how the Penang CM carry himself ? sit in a non-1st class airplane, dont spend so much money on the people.

When I was young, I anti-PAS, anti-DAP because I always followed the newspaper and TVs. They were labeled as anti-development, chaos-maker and the perception of that "they are stupid". Things changed when I visited Kelantan once I had my own vehicle. I was so wrong. I thought the Chinese there hated PAS because they were no establishment. But all the coffee shops uncle and aunty said, "No place to gamble is actually a good place to save money." Then another uncle who is a carpenter said, "I migrated from Terengganu, it is so hard to get a license to do business, everything needs to pay kopi money, but here it is so different, I just walk into Nik Aziz house, I got everything approved." PAS true to its principles has never alienated anyone in Kelantan. They ban the things that are supposed to be ban, liquor, gambling dents etc which the Chinese there eventually understand life is so much better without those things in mind.

As a Chinese, I am beginning to feel that Hadi Awang is Prime Minister stuff. He is definitely a more humble leader than any of the UMNO fellas who lives in gigantic mansions. True leaders are people who is out there to serve and not to be served. Just compare Nik Aziz, Hadi Awang and the opulent lifestyles of Ahmad Badawi and Najib. If for some reason that Anwar Ibrahim failed to make it as the Prime Minister, Hadi Awang is a good choice. I can trust this man. Yes, our perception of PAS has changed in recent times.

As for the Obama thing, we can wait a few more rounds of GEs. It took America more than 2 centuries to effect that change. Non-Malays can be the Prime Minister of this country someday. For now, we must begin the process of burying UMNO and the spirit of strife and divisiveness it has bred. Exorcise these evil spirits, then there will be true peace and harmony in this country. PAS since joining PR has always been consistent in their ideology. It is those UMNO goons who are envious of PAS being "partners in progress" with PKR and DAP that they just like to 'batu api' PAS to make them feel insecured in PR and also to make the PR supporters reject them. The PR supporters will always support all the coalition parties in PR through thick and thin.

I also see PAS in a different light since PR took over and through RPK's articles. The lifestyles of the PAS leaders compared to UMNO also attests to the credibility of the party to work for the interests of the people rather than to enrich the leaders. Should PAS rules the country I do believe corruption and the rich becoming richer will be minimised if not eradicated and if Hudud or syariah laws be implimented we will see many of our current leaders suffer the most. Ultimately the country will be a fairer and happier place to live in.

PAS supports many strong values that are also common and promoted by other religions. So the baseline appeal is already there. But PAS should be more inclusive if they want the mandate to govern non-muslims as well. And use common sense and human wisdom in actions, behavior, punishments, deterrents - sometime appropriate encouragement is better and more effective than coercion by rules and law.

Islam as a religion is not the problem. PAS has people who fear God and His word. UMNO makes money and creates selfish power using the name God and His word. That is all the difference we are seeing after March 8. A bit more tolerance on the rights and believes of non Muslims will make PAS as one of the strongest political parties in Malaysia.

I don't see any principles in PAS that shows it has good governance. First PAS claims race politics are discriminating in Islam's eyes, and they will be fair to all races. Then in Kedah they recently give 50% quota for bumiputera house ownership. Just because Hadi claims to be against money does not mean he is fair. PAS = Another UMNO with different clothes. (btw I'm anti-BN too)

Dear Michael Chick, Islamic Law never change. Mr. Hadi is referring to the law in Quran. However, the issue why 2 Sharia law never identical is because the Sharia law is altered by the local government to cater for their political agenda. Just like what written in Bible too. Can you tell me any single ordinary Christian that follow all the teaching in Bible? Is always better to refer to the scripture instead of the practice. I'm not emotional but just telling you the fact that happened in the world now.

The fact is every party has good and bad people, UMNO included (remember Zaid Ibrahim?). The problem we are facing is whether these "good people" have managed to put them in a position of power. In the case of UMNO, it is just that the good people are kicked out and the bad ones retained. It is simply that the culture developed over the years support bad people to become leaders in certain party. In this context, PAS is no different from UMNO; the real difference is currently PAS has produced more leaders who are good. The evolutionary answer to that is that PAS need good leaders to survive under the Malaysian political climate (hence, more good people are selected as leaders); UMNO feel it need not have such leaders to survive(which explains why UMNO continue to be led by hopelessly immoral and/or incompetent leaders). As shown again and agin over the past twenty years or more, it is those leaders who will toe the line and stay with the camp in power who will survive and thrive. Those who oppose are eliminated, thus sending a clear message. There is the evolutionary explanation to why those UMNO leaders who are most corrupt and racists seem to rise quickly to the top. Since many of the preceding top leaders are corrupt to the core and this is known, it is only natural for the lower ranks to develope the belief that they need to support such cultures (no matter how despical they are)to move upward - and time and again, this happens. Once Pas is in power, then we will see the true colour. So, sorry Hadi, I respect the good leaders in PAS, but not necessarily PAS Islamic policy. Based on what we see of Islamic governance all over the world, I see your interventionist religious policy more of a threat to than support of progress once PR is in power. I predict the religious excuse would be invoked to control and change things around in favour of Islam - even if it is against the wishes of those affected. It is not definitive statement of course; but this is a real risk the people who support Pakatan have to live with. And that is because UMNO is currently a non-choice!

I'm all for PAS islamic values for good governance which espouses fairness and equality. It is only when they talk about laws that regulate people that makes me a bit wary. Nevertheless, like what RPK mentioned, why should we fear PAS. They would not have the numbers to dominate. Besides even in PAS there are opposite views which are well tolerated unlike in Umno where the top leaders dominate and the rest merely "saya menyokong sepenuhnya dari dulu kini dan selamanya",even when the policies are clearly wrong. And a lot of PAS leaders them are persons of principles who believes that being politicians as a way for advancing their ideals rather than as a way to advance their desire for material wealth. I believe PAS is more pragmatic and sensitive than what we give them credit for.

At least PAS got principles, like saying NEP haram & un-Islamic, but UMNO says Ketuanan Melayu means to love Malays(DEB), putting importance of the monarchy(Syed Hamid (Dinar) Akhbar). How can UMNO defend Malay language when they don't understand thier own language. How can non-malays trust UMNO if they can't take care of their fellow Malays that they rhetorically wanted to help, but instaed help Malay-UMNO pulak?

How to judge the judge?

In The Sun newspaper, March 4, 2009, I read on page 1 this alarming report:

“Ipoh High Court grants injunction sought by Datuk Dr Zambry Abdul Kadir and the six State Executive Councillors to stop speaker V. Sivakumar from convening any state assembly sitting.Court also ruled that Sivakumar’s five lawyers have no legal standing to represent him in the case filed by Zambry to seek a declaration that Sivakumar’s decision to suspend him and his executive council was unconstitutional and unlawful.”

The arrogance of a novice judge

I must say I was taken aback by the astonishing ruling of the High Court judge. The full report is on page 6 of the newspaper. There I find that the judge was Mr Ridwan Ibrahim, a judicial commissioner. He ruled that the lawyers “engaged by Sivakumar had no locus standi to represent him in an application by Perak Mentri Besar Datuk Dr Zambry Abdul Kadir, who is seeking a declaration that Sivakumar’s decision to suspend him and his executive council was unconstitutional and unlawful”.

Sivakumar’s leading lawyer was Mr Tommy Thomas, and I quote from the newspaper of what he said:

“Thomas recounted what happened in chambers at a press conference outside the court.He said the judge had earlier asked that only one lawyer from each party enter his chambers, so he (Thomas) went in on behalf of Sivakumar, while Zambry was represented by a counsel and the state legal officer.‘An objection was made against me and my team, saying that we had no locus standi to represent the Speaker’.”

The objection was under section 24 of the Government Proceedings Act:

” … ‘the judge ruled against us saying that we had no locus standi and therefore we cannot defend the Speaker who can only be represented by the state legal adviser’.. . . when he asked if he couid sit in and hold a watching brief with speaking rights, Ridwan ruled that no speaking rights would be granted but he could hold a watching brief.”

I am appalled at the arrogance of the judge. I am quite sure he is not an expert in constitutional law and even if he were, in a case of such great public importance to the nation, it is wise to listen to the views of the other side. Especially in this case, when eminent counsel Mr Tommy Thomas was available to assist him. The judge could have invited him to submit as an amicus curiae - in Latin it means ‘friend of the court’ and when the phrase is used in a court of law i means ‘one who advises the court in a csae’. I have done that many times even when I was in the Court of Appeal. Judges of far greater eminence than this Judicial Commissioner have often asked lawyers of great experience who are in the court for their valued views. Yet this judge thought he knew everything that he did not require any assistance from one of the top lawyers in the country.

Dick Hamilton in his book Foul Bills and Dagger Money wrote, at pages 244, 245:

It is always easy to criticise judges, and some of them deserve it from time to time; but it is even easier to underestimate the difficulty of their task, and to take their successes for granted. No member of the Bar pretends to understand every branch of the law. … But a High Court Judge has to deal with any sort of case which comes before him.”

In order for the judge to tackle all sorts of cases which come before him, the wise and able judge is always humble enough to ask any of the lawyers in court who is an expert in his field for assistance. Here we have Tommy Thomas who is one of the top lawyers in the country who was only too willing to assist the judge, yet this probationary judge, who thinks he knew more law than some of the most eminent judges who have sat on the bench, refused to hear Mr Thomas.

How you can judge this judge

You cannot judge a judge unless you know the basic law yourself. But you do not have to worry because I shall now provide you with the law applicable so that you are in a position to judge the judge. You may be surprised at your own ability after you have read this. You might think that even a layman, after reading the applicable law, knows what is the right decision to make. And when a judge does not know the correct answer, it makes you wonder how such a thing could have happened.

On section 24 of the Government Proceedings Act 1956

I shall start with section 24 of the Government Proceedings Act 1956. I have highlighted the important words for easier reading. Subsections (1) reads:

“(1) Notwithstanding any written law(a) in civil proceedings by or against the Federal Government …(b) in civil proceedings by or against the Government of a State a law officer … authorised by the Legal Adviser of such State … may appear as advocate on behalf of such Government … “

As you can see this subsection is not relevant as it only applies to civil suits brought by or against the State Government.

And subsection (2), which is relevant on the subject of discussion, reads:

“(2) Notwithstanding any written law in civil proceedings to which a public officer is a party -(a) by virtue of his office; or(b) in his personal capacity, if the Attorney General certifies in writing that it is in the public interest that such officer should be represented by a legal officer;a legal officer may appear as advocate on behalf of such officer … “

See also section 2 of the Act which gives the definition of:

” ‘legal officer’ includes a law officer”” ‘law officer’ means . . . in respect of proceedings by or against the Government of a State or to which a State officer is a party, includes the Legal Adviser of such State”

This subsection only applies to civil suits brought by or against a public officer. In such a case, a public officer may (the word is “may” not “must”) be represented by a legal officer which could include the Legal Adviser of the State. There is, therefore, nothing in section 24(2) of the Government Proceedings Act to suggest that a public officer if he sues or if he is sued must be represented by a legal officer such as the State Legal Officer.

In any case, section 24(2) of the Government Proceedings Act only applies to civil proceedings to which a public officer is a party. Therefore, the question is, does the Speaker of the Legislative Assembly of a State hold office as a member of the public service - if he does then he is a public officer. Article 132, Clause (3) of the Federal Constitution states that:

“(3) The public service shall not be taken to comprise -(a) …(b) the office of President, Speaker, Deputy President, Deputy Speaker or member of either House of Parliament or of the Legislative Assembly of a State;”

So now you know that the Speaker and the members of the Legislative Assembly of a State are not part of the public service as they do not hold office as such public officers. Therefore, section 24(2) of the Government Proceedings Act does not apply to them. Now we all know, except the judge because he thought he knew better, that Mr Tommy Thomas could not be prevented to appear for the Speaker Sivakumar. If only he would hear Mr Thomas, instead of barring him from speaking, he would not have made such a grave error.

On the conflict between the Speaker of the Legislative Assembly and the Law

According to newspaper reports the case is an application by Mentri Besar Zambry to the court the decision of the speaker Sivakumar in the legislative assembly to suspend him and his 6 exco members unconstitutional and unlawful. The question is, can the courts decide on the validity of the proceedings in the Legislative Assembly?

The answer is staring right at us here in Federal Constitution. Article 72, Clauses (1) to (3) states:

“(1) The validity of any proceedings in the Legislative Assembly of any State shall not be questioned in any court.

(2) No person shall be liable to any proceedings in any court in respect of anything said or any vote given by him when taking part in proceedings of the Legislative Assembly of any State or of any committee thereof.

(3) No person shall be liable to any proceedings in any court in respect of anything published by or under the authority of the Legislative Assembly of any State.”

So now you know from the Federal Constitution itself that the validity of the suspension of Zambry and his 6 exco members by the Speaker in the State Assembly cannot be questioned in any court.

Lord Denning tried to inquire into a private Act of Parliament on the ground that Parliament was misled by fraud but he failed. The case is Pickin v. British Railways Board [1974] A.C. 765. He recounted this in his book What Next in the Law at page 319:

“A little while ago there was a case where the British Railways Board got a private Act vesting a man’s land in the Board without payment. He alleged that Parliament had been misled by fraud. In the Court of Appeal we held that the judges could inquire into it. But the House of Lords overruled us. They held that no inquiry by the judges could be permitted.”

It is important to remember that the United Kingdom does not have a written constitution. What more when we have a written constitution which says that “the validity of any proceedings in the State Legislative Assembly shall not be questioned in any court”.

From what we have read from the newspapers it seems that there is an injunction against the Speaker. You may also wonder how an injunction can be obtained against the Speaker when our written constitution says that “no person shall be liable to any proceedings in any court in respect of anything said or any vote given by him when taking part in proceedings of the Legislative Assembly of the State”.

In The Family Story, Lord Denning tells us this story, at pages 194, 195:

“I would recall the great case of Ashby v. White 1 Smith’s Leading Cases 253 in 1703. There was a conflict between the House of Commons and the Law. A ‘poor indigent’ man named Mathias Ashby went to the polling booth and claimed a right to vote for two members of Parliament: but the voting officers refused to allow him to vote on the ground that he was no settled inhabitant of the borough. Ashby brought an action for damages. The House of Lords then resolved that Ashby was entitled to bring his action and to recover his damages of £5. The House there not only vindicated the fundamental right of a citizen to vote, but it also established the great principle that wherever a man has a right, he shall have a remedy at law to enforce it.
The decision, so clearly a broadening of freedom, was, however, furiously opposed by the House of Commons. They ordered the arrest of the solicitor who acted for Ashby; and they committed to prison five other men simply because they, like Ashby, brought actions against the returning officers. These men applied for a writ of habeas corpus. They had counsel to argue for them. But the House of Commons thereupon took action against the counsel. The Sergeant-at-Arms actually arrested two of the counsel and would also have liked to have taken a third, Mr Nicholas Lechmere, ‘but that he got out of his chamber in the Temple, two pair of stairs high, at the back window, by the help of his sheets and a rope’. The controversy between the two Houses was only resolved because Queen Anne prorogued Parliament and the prisoners were released.”

The above account is not as strange as it seems. It is the common law of England and the common law of England that was in force on 7 April 1956 is embodied into the common law of West Malaysia, and the state of Perak is in West Malaysia, by virtue of section 3(1) of the Civil Law Act 1956.

There is an interesting episode in Lord Denning’s The Family Story about a breach of the privileges of the House of Commons. He wrote, at page 192:

“In the ordinary way there is no conflict between our two great institutions - Parliament and the Courts. But in exceptional cases there has been. … The Houses of Parliament enjoy certain privileges. One of them is freedom of speech. Erskine May says: ‘What is said or done within the walls of Parliament cannot be enquired into in a court of law’.”

At page 193:

On 8 February 1957 Mr Strause M.P. wrote a letter - on House of Commons paper - to Mr Maudling, the Paymaster-General. He complained of the behaviour of the London Electricity Board. He said that they were disposing of scrap cables at too low a price. He said their conduct was a scandal. Mr Maudling … passed the complaints on to the London Electricity Board. … The Board’s solicitor on 4 March 1957 wrote saying:Your letter is wholly unsatisfactory and we are instituting proceedings …That simple solicitor’s letter raised the great constitutional issue. Who was supreme? Parliament or the Courts of Law? Mr Strause said the letter (threatening a writ) was a breach of the priveleges of Parliament, and that the Board and its solicitor were punishable by the House itself. The London Electricity Boardsaid that they were entitled to have recourse to the Courts of Law and that the House of Commons could not stop them.The issue was referred to the Privy Council. Seven Law Lords sat to hear them. I was one of them. I found myself in a minority of one. . . . They held that the House of Commons could treat the issue of a writ against a Member of Parliament - in respect of a speech or proceeding in Parliament - as a breach of its privileges.”

At page 194:

“So if you read the Report in the Law Reports - re the Parliamentary Privileges Act 1770 [1958] A.C. 331 - you would think that it was a unanimous opinion of all seven,”

Those of you who are lawyers will know that the decision or advice of the Privy Council is given as a single opinion - only the majority view is given.
