Khir Toyo (di Selangor) juga merasakan treatment yang sama tapi sikap beliau masih macam pemerintah bukan pembangkang.

Bagi wakil rakyat PR...kena ambil iktibar agar tidak lalai dan leka. Langit tidak selalu cerah yob.

Umno’s growing ease in opposition

It was when the sole opposition assemblyman, Phee Boon Poh (DAP-Sungai Puyu), was facing a phalanx of BN reps in the house. The veteran opposition man had on that day raised a motion but, as expected, no one seconded him. The speaker dropped the idea at once.

It is said that seated across Phee’s opposition chair, on a section reserved for state executive councillors, Umno state secretary Datuk Seri Azhar Ibrahim (Penaga) laughed.

Those who witnessed that moment still recall how Phee jumped up in a rage, and in a dramatic proclamation that sent tremors around the august hall, told Azhar to await the day when their roles would be reversed. There may not have been any thunder or lightning flashing across the sky when Phee warned Azhar that he would find himself sitting on the very opposition chair Phee was occupying while Phee himself would sit in the section meant for the government.

But the weight of prophecy is not lost today among those who had been witnesses to Phee’s outburst. Indeed, when the first term of the 12th state assembly convened, Azhar did find himself in the very seat Phee had occupied.....

.......Azhar, now official state opposition chief, became more formidable, cornering and countering the state government’s new policies and actions with a variety of impressive and intelligently expressed angles; while firebrands like Roslan Saidin (Pinang Tunggal) and Muhamad Farid Saad (Pulau Betong), though still prone to occasional bouts of temper, had markedly toned down.

It will be interesting to observe how this trend of the Umno boys, slowly but surely, becoming more at ease in their roles in the Opposition over the next few years. It was after all a scenario that was hardly imaginable as being possible just two years ago.

There was, in spite of this transformation that Umno had undergone, one brooding image (ha ha) that will endure from the assembly’s recent term. When Phee made a surprise announcement that smoking would be banned in the state assembly premises, the one person it most affected was Azhar, a smoker for more than 30 years.

And so everyday during assembly breaks, the man who had once laughed at Phee found himself standing outside the gates to get his puffs, his gaze occasionally directed at the Pakatan-controlled assembly like a sulking schoolboy.

It may not necessarily be a fitting turn of events, but it certainly made for dramatic scene in the thrilling, ever-changing script of the Penang State Assembly.

IPOH, April 30 — Chan Nyarn Hoi lives in a modest two-storey semi-detached house in a quiet lane near the state stadium in Perak with his wife, a dog and seven large Japanese carp.

At 74 years old and with ruddy smooth cheeks under a full head of snowy white hair, few would connect him to the acerbic, no-nonsense former judge Datuk N.H. Chan, who has in the last couple of months done the unthinkable: fire away missives at judges who have trampled on the Federal Constitution in deciding issues related to the power grab in Perak. His lengthy articles have reminded Malaysians of a time gone by when towering individuals sat on the Bench and simplified the Perak constitutional crisis for the common man.

Still seething over the events that transpired in Perak and decisions of the apex court, he says that if Malaysians are upset with the state of the judiciary and think that the present crop of judges are not up to the mark, they should exercise the power of their vote to change the state of affairs in the country.

Born in Ipoh on March 27, 1935, Chan was admitted to the Bar in 1961. He was a lawyer for almost two decades before becoming a High Court judge and moving to Kuala Lumpur.
He was among the first batch of High Court judges to be elevated to the Court of Appeal, set up in 1994 to act as an intermediate court between the High Court and the apex court.

Chan's first book, “Judging the Judges”, was published in 2007 and is a collection of his articles for the Perak Bar. Only 1,000 copies were published.

His second book, “How to Judge the Judges”, is expected to come out some time in the middle of the year. The final draft has just been sent to the publishers. They wanted him to include the Perak saga as well, but because it is ongoing, he had to draw a line somewhere. He has included some information in the epilogue.

In an exclusive interview, the former judge, who was recommended to the Bench by none other than Sultan Azlan Shah, the Sultan of Perak and a central figure in the present crisis, tells The Malaysian Insider why he feels compelled to speak out.

Q: Unlike many former judges, you have been very vocal in your criticisms against the judiciary. What drives you?

A: In the first place, I am not against the judiciary. I am sure there are some good judges around, only they have not manifested themselves in the present constitutional, should I say, crisis in Perak.

I expected James Foong JCA (as he then was, he is now a Federal Court judge) to do the right thing but he failed to do that. I suppose it takes great courage for a Court of Appeal judge who sat as a winger in the Federal Court to give a dissenting judgment.

Now, back to your question. When I became a judge I had to be true to my calling which is to know that the essence of justice is fair trial and the duty of the judge is to administer it according to law.

Lord Devlin in his book “The Judge”, wrote on page 4: “...impartiality and the appearance of it are the supreme judicial virtues. It is the verdict that matters, and if it is incorrupt, it is acceptable. To be incorrupt it must bear the stamp of a fair trial.”

And at page 85 he said: “The first — ought one to say the whole — duty of the judge is to administer justice according to law.”

Back to page 3, the book said: “What is the function of the judge? Professor Jaffe has a phrase for it — 'the disinterested application of known law' (Jaffe in his book “English and American Judges as Lawmakers”, page 13)”

This means that the judge's only duty is to do justice in the disinterested application of known law. Known law means basic law and the term includes both common law and statute law.

The judge who gives the right judgment but does not appear to be impartial is useless to the judicial process. After that, the judge's whole duty or function is to decide the case according to law on the admissible evidence before him.

And what do you call a judge who does not administer justice according to law? A renegade judge? So now you know why I am so vocal when I admonish the errant judges who did not apply unambiguous law as it stands.

Q: You have been especially blunt in your views over the issues in Perak. Why so?

A: You mean for calling a spade a spade? What do you call a judge who doesn't follow or apply easy to understand and unambiguous statute law as it stands?

Like Article 72(1) of the Federal Constitution which says: “The validity of any proceedings in the Legislative Assembly of any State shall not be questioned in any court”.

This law applies to all members of the legislative assembly — it does not matter if you are DAP or PKR or MCA or Barisan Nasional or any political party. Even a child could understand the plain meaning of the words. We do not need the Federal Court to interpret (meaning “explain the meaning of”) the words for us. Nor do we need any law professor from Singapore to tell us Malaysians that the courts should have the power of judicial review over what has transpired in Parliament or a Legislative Assembly.

There is separation of powers between the Legislature and the Judiciary of this country. We all know that one can apply to the courts for a judicial review over executive actions. But there is no such thing as judicial review over what transpired in the legislature — if there is such a thing then we can have judicial review over the passing into law of certain Acts of Parliament that we don't like — like the ISA.

A long time ago when I was a High Court judge, I have sentenced many criminals to death without qualms. But personally I am against the death sentence because it is barbaric. But as a judge I must apply the law as it is.

To quote Lord Denning: “It is their [the judges] duty to administer and apply the law of the land. If they should divert it or depart from it — and do so knowingly — they themselves would be guilty of a misuse of power.”

I would never dream of doing such a thing.

Q: Why did you choose to air your views so publicly? I'm trying to understand why you got involved.

A: I'm only an outsider and I don't care. But when everybody is missing the point and all that — and some of them have not even read the Perak Constitution, I thought I better explain why the people are angry.

Q: Why do you think the people are angry?

A: Do you know why the Perakians were up in uproar against the Sultan of Perak?

It's because, as any lawyer will tell you, especially as he was Lord President before, that before you make a decision, you cannot see the parties. If you want to meet any of the parties, both of them must be present. You never do so by seeing one and then making a decision. The moment you do that, to the losing side or to any observer will think you have been influenced. So it's the impression that counts.

They were angry with the Sultan because they can sense it in their bones that it is wrong to make a decision to see the other side first.

Q: Is the Sultan morally wrong or legally wrong?

A: If the Sultan had executive powers to rule, it is legally wrong, so they could apply for judicial review of the Sultan's decision. But I pointed out in my first article he has no executive power to rule because he is not an executive monarch, he is a constitutional monarch. What he did was morally wrong.

Q: You must have seen many things during your time as a judge. What is wrong with Malaysia’s justice system? What can be done to correct it? And what’s stopping the necessary changes from taking place?

A: I don't think there is anything wrong with our judicial system. It is the players that we should be concerned with — if we get the right people on the Bench, that is, those people who are not interested in power — because power corrupts, those fair-minded individuals who would administer justice according to law, then we will have a judiciary to be proud of.

We used to have that at one time. And if the general public think that the present crop of errant judges are not up to the mark, then the remedy is to use the power of the vote to change the present state of things.

At the general election of 1906 the common people of England toppled the Conservative Government of the day because they were unhappy with the decision of the House of Lords in the Taff Vale case which had virtually put an end to trade unions six years earlier.

That case had immense political consequences. At the general election of 1906 the opposition pledged complete immunity for trade unions.

Lord Denning said in his book “Landmarks in the Law”, page 121: “The result of the general election was like an earthquake. ... It was a sweeping victory for the trade unions. Parliament immediately passed the Trade Disputes Act 1906. It is probably the most important Act ever put into the Statute Book. It reversed all the judicial decisions against trade unions. The Taff Vale case was overruled. No trade union could thereafter be sued for damages for any wrongs done by its members. Its funds were unassailable.”

There is a well known Spanish proverb which says, “He who goes with wolves learns to howl.” So that if the electorate don't trust the judges they tend to put the blame on the government who put the judges there.

Q: Many ordinary Malaysians today feel powerless to affect positive changes to the institution of the judiciary because they lack legal knowledge. Do you agree with this view? How do you think they can work to bring about the change they want?

A: I think the real problem is this. In most cases when you read about a court decision in the newspapers, the judgment of the court is expressed in such a way that the average reader will not know if the judge is right. So invariably, we assume that the judge must be right.

I do realise the problem, so I thought I should try to explain the issue in simple language so that everyone will be able to judge for himself whether the judge is doing the right thing or not.

Lord Denning was famous for explaining difficult law in such a way that any lay reader can understand it. Now that they know how to judge the judges by reading my articles, they could, if they thought they have been short-changed by the judges, do the same thing as was done by the electorate in 1906 England. They have the power to change the government of the day by their vote in the next general election.

The opposition, in order to get the people's vote, could pledge to undo all the wrongs done to the community by the judges. They could pledge that if they were given the mandate of the people to form the next government, they would pass an Act of Parliament to overrule such unjust decisions of the Federal Court such as Adorna Properties vs Boonsorm Boonyanit, the Asean Security Mills, PP vs Datuk Seri Anwar Ibrahim as well as all the decisions of the Federal Court pertaining to the Perak constitutional crisis which were not decided according to law — where the court had blatantly refused to apply Article 72 of the Federal Constitution.

They could also pledge to remove the errant judges from office. This is how it could be done.
In “What Next in the Law”, Lord Denning said, page 319: “Parliament is supreme. Every law enacted by Parliament must be obeyed to the letter. No matter how unreasonable or unjust it may be, nevertheless, the judges have no option. They must apply the statute as it stands.”
Yet the errant judges, especially the five in the Federal Court, have refused to apply Article 72 of the Federal Constitution as it stands.

In his book, “The Judiciary in Malaysia” (Asia Pacific Publications Sdn Bhd, 1994) the then Chief Justice of Malaysia Tun Abdul Hamid Omar said, page 88: “... the provisions dealing with the removal of judges in pursuance of an address in Parliament … was modified to provide for a special tribunal to be established for the removal of judges.”

That is incorrect. Actually Article 125(3) of the Federal Constitution only applies to judges of the Federal Court.

At the time of the fracas between the then Lord President Tun Salleh Abbas and Prime Minister Datuk Seri Dr Mahathir Mohamad in 1988, Article 125(3) of the Federal Constitution provides for the removal of judges of the Federal Court on the ground of “misbehaviour or of inability”.
Article 125(3) and (4) reads:

“125(3) If the Prime Minister, or the Lord President after consulting the Prime Minister, represents to the Yang di-Pertuan Agong that a judge of the Federal Court ought to be removed on the ground of misbehaviour or on the ground of inability, from infirmity of body or mind or any other cause, properly to discharge the functions of his office, the Yang di-Pertuan Agong shall appoint a tribunal in accordance with Clause (4) and refer the representation to it; and may on the recommendation of the tribunal remove the judge from office.

“125(4) The said tribunal shall consist of not less than 5 persons who hold or have held office as a judge of the Federal Court, the Court of Appeal or a High Court or, if it appears to the Yang di-Pertuan Agong expedient to make such appointment, persons who hold or have held equivalent office in any other part of the Commonwealth, and shall be presided over by the member first in the following order, namely, the Chief Justice of the Federal Court, the President and the Chief Judges according to their precedence among themselves, and other members according to the order of their appointment to an office qualifying them for membership (the older coming before the younger of two members with appointments of the same date).”

The book “The Judiciary in Malaysia” said — this part is significant so do pay special attention to it — page 89: “Until the recent amendment in 1994, the grounds for the removal of a judge was 'misbehaviour or of inability', The Constitution (Amendment) Act 1994, however, substituted for the word 'misbehaviour', the words 'any breach of any provision of the code of ethics prescribed under Clause 3A...'. The effect of this amendment is that, besides the inability, either from infirmity of body or mind, or any other cause, properly to discharge the functions of his office, a judge may be removed if he has breached the code of ethics prescribed for judges.

“Article 125(3A) provides that the code of ethics shall be observed by every judge, be it, the judge of the Federal Court, the Court of Appeal or the High Court.”

This is what Section 2 of the Judges' Code of Ethics 1994 says:
“2(1) This Code of Ethics shall apply to a judge throughout the period of his service.
“2(2) The breach of any provision of this Code of Ethics may constitute a ground for the removal of a judge from office.”

So now we all know that any serving judge could be removed from office for a breach of any provision of the Judges' Code of Ethics 1994.

Section 3(1)(d) is the provision in the Code of Ethics to apply against the errant judges. It reads: A judge shall not conduct himself dishonestly or in such a manner as to bring the Judiciary into disrepute or to bring discredit thereto”.

I think the words in Section 3(1)(d) are clear enough — we all know what they mean. So that if a judge brings the judiciary into disrepute or discredit, as the errant judges have done by not administering justice according to law, they could be removed from office under this provision. It's a bit harsh, but it can be done.

Teman telah menyatakan pendirian teman dan tetap begitulah pendirian teman walaupun dihentam oleh rakan2.

Teman juga telah membaca tulisan susulan Nik Abduh... kerja - kerja bodoh dalam pas (2) . Nadanya lembut sikit tapi isinya lebih kurang itu jugalah. Terlalu banyak bunga2 bahasa tetapi mesejnya kalu diringkaskan...begitulah.

Sokongan paling kuat datang dari Ustaz Nasrudin Tantawi...Penjelasan Ustaz Nik Abduh. Dia paling mengenali Nik Abduh, mungkin selepas TGNA sendiri...

Namun yang paling menarik pada teman ialah tulisan YB Khalid Samad di dalam blog beliau yang memberikan kefahaman yang mendalam akan isu yang diperbincangkan...Mi Celup. Ini barulah dinamakan pemimpin. Padat, berterus terang dan penuh fakta.

Tiada sentimen emosi dan menulis berdasarkan fakta adalah yang terbaik dalam menangani kemelut ini.

Idea BN Yang Semua Makhluk Kat Dunia Boleh Jangka....

Usul lucut jawatan Sivakumar sebagai Speaker

Pejabat Setiausaha Dewan Negeri Perak telah menerima satu usul untuk melucutkan V Sivakumar dari jawatan Speaker Dewan Undangan Negeri (DUN) Perak.

Usul tersebut dicadangkan oleh Menteri Besar, Datuk Seri Zambry Abd Kadir dan disokong oleh ADUN Sungai Rapat, Datuk Hamidah Osman.

Menurut Setiausaha DUN Perak, Abdullah Antong Sabri, usul tersebut telah diberi notis untuk dibawa di dalam mesyuarat pertama, penggal kedua, DUN Perak ke-12 pada 7 Mei depan.

"Sekiranya usul ini diluluskan di dalam mesyuarata tersebut, maka urusan mesyuarat berikutnya ialah pemilihan Speaker DUN yang baru akan dibuat," katanya dalam surat yang dihantar kepada ADUN Perak.

ADUN Tebing Tinggi, Ong Boon Piow dari DAP, mengesahkan telah menerima surat tersebut jam 2 petang ini. Ia dihantar melalui khidmat hantaran laju.

Sehubungan itu, Abdullah meminta ADUN-ADUN mngemukakan cadangan nama Speaker yang baru.

Borang pencalonan Speaker baru itu turut dikepilkan bersama surat tersebut.

Menurut Abdullah, borang pencalonan itu hendaklah dikemukakan beserta borang persetujuan ahli yang dipilih kepada pihak pentadbiran (DUN) selewat-lewatnya esok, 30 April.

Sementara itu, Setiausaha DAP Perak, Nga Kor Ming, ketika dihubungi Malaysiakini berkata, ia adalah insiden pertama dalam sejarah Malaysia untuk melucutkan seorang Speaker.

Beliau yang juga ADUN Sungai Remis dan ahli Parlimen Taiping merasa terkejut dan menyifatkannya sebagai satu tindakan yang luar biasa.

Sehubungan itu, Nga mengecam BN kerana menggunakan Abdullah yang telah dipecat oleh Speaker sebelum ini, utnuk mengeluarkan surat tersebut.

Katanya, semua itu menunjukkan bahawa BN telah bertindak sewenang-sewenangnya.

Katanya, menurut peraturan tetap DUN Perak, Speaker (Sivakumar) mempunyak hak untuk menerima atau menolak sebarang usul, termasuk usul untuk memecatnya.

Nga menyamakannya dengan tindakan Speaker DUN Melaka menolak usul tidak percaya yang dibentangkan oleh wakil DAP terhadap Ketua Menteri Melaka, Datuk Seri Mohd Ali Rustam minggu lalu.

Beliau mendakwa tindakan Zambry itu menghina mahkamah, kerana prosiding kes sama ada beliau merupakan menteri besar Perak yang sah. masih belum selesai.

Yang Dipertuanya, Omar Hassan berkata, keputusan tersebut dibuat sebulat suara dalam mesyuarat jawatankuasa PAS kawasan itu malam tadi. DUN Penanti terletak dalam kawasan parlimen Permatang Pauh.

Begitulah berita yang dipetik dari Malaysiakini sebentar tadi.

Nasihat teman...jangan terburu2 dan jangan angkuh.

Kita dulu menangpun bukan sangat atas kekuatan kita sendiri. Ia berkat kerjasama dan kesepakatan dan sudah tentu kurnia Allah. Jangan lupa itu semua dan jangan tamak. Sabar dalam perjuangan.

Jemaah SUA..Insya'Allah akan turun padang macam biasa. Tak kiralah Pas Permatang Pauh nak beku jadi air batu ke ape ke....

MB DPulau memalukan Sultan Perak?

Tindakan MB DPulau yang memohon agar Mahkamah Persekutuan mengistiharkan yang beliau adalah MB Perak yang sah bolehlah ditafsirkan bahawa beliau telah hilang kepercayaannya kepada kuasa Sultan. Sekiranya MB DPulau percaya kepada keesahan kuasa Sultan,beliau tidak perlu memohon mana-mana mahkamah untuk mengistiharkan siapa MB Perak yang sah. MB DPulau hanya perlu berdiam diri sahaja melayani kerenah MB Nizar. MB DPulau mesti yakin bahawa mahkamah akan menyebelahinya walaupun berpuluh kali MB Nizar membawa kes jawatannya di mahkamah.

Apabila diperhalusi lagi, MB DPulau sebenarnya telah turut menderhaka kepada sultan. MB DPulau telah tidak percaya kepada keputusan dan kuasa sultan. MB DPulau telah ragu-ragu tentang statusnya sebagai MB Perak. Majoriti rakyat pelbagai kaum telah tidak menghormatinya sebagai MB. MB DPulau terpaksa memohon bantuan mahkamah. Tetapi mahkamah masih bermain sorong papan tarik papan. Walaupun mungkin mahkamah telah ditentukan keputusannya, hakim seolah-olah tidak sanggup membacakan keputusan yang bukan daripada ilmu dan hukum hakam perundangan sebenar. Kes ini di luar bidang kuasa Mahkamah Persekutuan. Ini kes Mahkamah Tinggi. Mahkamah Persekutuan menolak untuk mengistiharkan bahawa MB DPulau adalah MB Perak yang sah. Ternganga mulut MB DPulau!

Daripada sudut bicara politik kepartian, keputusan Mahkamah Persekutuan ini telah membantu menambahkan kekuatan PR. UMNO pula semakin parah. UMNO pula semakin hilang peminatnya. Peminat UMNO telah getik kepada pemimpinnya. Dahulu UMNO begitu percaya bahawa PR sahaja yang menderhaka kerana engkar kepada titah sultan. Hari ini pemimpin UMNO pula yang memalukan sultan kerana mempertikaikan keputusan sultan di mahkamah. Rupa-rupanya barulah orang UMNO sedar bahawa mahkamah lebih besar lagi kuasanya daripada sultan.

Di Perlis, Shahidan masih mengeluh kerana Raja Perlis tidak melantiknya sebagai MB Perlis. Di Terengganu, kumpulan Wahid Rosol masih mempertikaikan perlantikan MB pilihan Sultan Terengganu. Di Perak pula, MB DPulau mahukan mahkamah mengistiharkan dirinya sebagai MB Perak yang sah. Pengistiharan Sultan Perak bahawa MB DPulau adalah MB Perak rupa-rupanya belum disahkan lagi. Tindakan MB DPulau membawa kes ini ke mahkamah telah secara langsung mencabar keesahan kuasa yang ada pada Sultan Perak.

Rumusannya, siapa yang sebenarnya telah dan sedang derhaka kepada sultan? PR atau UMNO?

November Dah Bankrupt...Sampai La Ni SPR Tak Buat Apa...!!

Hari Isnin lepas keluar dalam The Star kisah ADUN Kuala Nerang yang mintak bantuan Timbalan Presiden Umno, Muhyiddin untuk selesaikan masalah bankrupt dia.
Yang teman tau bankrupt ni boleh settle kalu hutang piutang tu dilangsaikan dulu. Atau gunakan kuasa arah mahkamah tarik balik keputusan ke apa bende ke...!!
Hari ni confirm Umno akan tolong. Option mana dia pakai tak taulah teman...tapi kalu pakai duit rakyat untuk selesai hutang dia...teman tak halalkan satu senpun. Kalu pakai satu lagi option.. dah salahguna kuasalah tu.
Tapi tu satu hal...keputusan bankrupt ni dah keluar...Last Nov 3, the Alor Setar High Court declared Syed Sobri a bankrupt following a suit filed by a bank to recover debts amounting to more than RM150,000, sparking off speculation of a possible by-election.

Krisis Perak: Soal Jawab Undang2...


Saya mengucapkan terima kasih di atas keperihatinan Dato Hafarizam untuk menjawab artikel saya yang tersiar secara meluas di alam internet ini (“ Zambry perolehi perintah yang tidak laku” ) Paling kurang saya berterima kasih beliau membaca artikel saya. Terima kasih sekali lagi.

Sebagai peguam saya menghormati pendapat beliau dan bagi saya tidak salah untuk beliau mengambil keputusan menjawab artikel saya tersebut . Menyanjung roh demokrasi yang sebahagiannya adalah kebebasan bersuara , kita wajar menghormati kenyataan beliau ketika menjawab artikel saya tersebut.

Saya tidak bercadang menjawab satu persatu apa yang beliau tulis sebaliknya memadailah saya hanya menjawab isu teras yang beliau bangkitkan di dalam kenyataan beliau tersebut.

Ramai meminta saya jelaskan kenyataan beliau bahawa

"Keputusan Mahkamah Persekutuan bahawa penggantungan Menteri Besar BN Perak, Datuk Seri Dr Zambry Abdul Kadir dan enam exco kerajaan negeri itu oleh Speaker DUN Perak, V Sivakumar batal dan tidak sah, adalah konklusif dan tidak boleh dipertikaikan"

Sebenarnya kalau para pembaca membaca tulisan saya dan memahami betul-betul apa yang saya cuba sampaikan, para pembaca akan tahu bahawa dua perintah deklarasi ( perisytiharan ) yang Zambry dan enam exconya perolehi tidak membawa apa-apa kesan.

Bagi sesiapa yang pelajari dan terdedah dengan undang-undang pentadbiran ( administrative law ) mereka akan tahu perintah deklarasi sahaja tidak cukup kuat untuk mengikat Sivakumar.

Memanglah susah nak terangkan pada mereka yang bukan ahli undang-undang ( laymen ) khususnya ahli dan penyokong Umno tentang apa dia certiorari dan apa dia mandamus kerana bukan sahaja orang awam susah untuk faham malahan tidak semua para peguam juga dapat memahaminya atau memahaminya dengan baik..

Saya tidak pasti sejauh manakah Dato ‘Hafarizam biasa dengan kes-kes semakan kehakiman ( judicial review ) dan jenis-jenis perintah ( remedies ) yang biasa dipohon di dalam kes-kes semakan kehakiman.

Bagi pihak saya dan bukan niat nak membanggakan diri, sudah hampir 16 tahun saya menjadi pengamal undang-undang dan dalam tempoh tersebut antara cabang undang-undang yang saya banyak kendalikan kes adalah melibatkan kes-kes semakan kehakiman .

Saya akui tidak semua kes saya menang tetapi pendedahan kepada undang-undang tersebut agak mungkin agak lebih sikit dari Dato’ Hafarizam ( yang juga kawan baik saya ).

Saya lihat di dalam jawapan beliau kepada artikel saya , Hafarizam tidak menjawab mengapakah Zambry tidak memohon perintah certiorari ( quashed the decision of Sivakumar ) dan perintah mandamus ( supaya Sivakumar benarkan beliau dan enam exconya masuk ke dalam siding DUN Perak ).

Hakikatnya apabila persoalan tersebut dibangkitkan oleh Haji Sulaiman Abdullah, peguam Zambry iaitu Encik Fairuz Hussin mengakui bahawa berdasarkan doktrin pengasingan kuasa Zambry tidak dibenarkan memohon dua perintah tersebut.

Berdasarkan jawapan dari Encik Fairuz tersebut, beliau sendiri mengakui bahawa Zambry terikat dengan doktrin pengasingan kuasa - bermakna Mahkamah tidak boleh perintah untuk Speaker membuat sesuatu atau melarang speaker membuat sesuatu. Dengan lain perkataan Fairuz mengakui Zambry tidak boleh mendapatkan perintah certiorari dan mandamus ke atas Sivakumar.

Tanpa perintah certiorari dan mandamus sebaliknya hanya mendapat perintah deklarasi sahaja , ianya tidak membawa apa-apa kesan kerana perintah deklarasi tidak boleh memaksa Sivakumar membuat sesuatu atau melarang Sivakumar membuat sesuatu perkara.

Bagi orang awam mereka mungkin bertanya kenapa perintah deklarasi bersifat begitu?

Saya boleh jawab tetapi saya jika saudara tanya begitu samalah seperti saudara tanya seorang doktor kenapa ada ubat demam dalam bentuk pil dan ada dalam bentuk minuman atau pun saudara tanya seorang Ulama kenapa solat zohor empat rakaat dan kenapakah solat subuh hanya dua rakaat?

Di dalam kenyataannya Hafarizam menyatakan bahawa isu mengapa Zambry tidak memfailkan semakan kehakiman sebaliknya hanya memfailkan Saman Pemula sahaja tidak wajar ditimbulkan kerana Mahkamah Persekutuan telah menolak bantahan peguam Nizar berkenaan isu tersebut.

Ya, benar Mahkamah telah menolak bantahan awal peguam Nizar terhadap isu tersebut, Tetapi apa yang Hafarizam tidak jelaskan adalah meskipun Mahkamah menolak bantahan tersebut ianya tidak bermakna perintah -perintah deklarasi yang Zambry pohon sama tarafnya ( dari segi kekuatan dan keberkesanannya ) dengan perintah seperti perintah certiorari dan perintah mandamus.

Hafarizam mungkin terlupa untuk menyatakan bahawa dengan penolakan bantahan tersebut , Mahkamah , pada hemat saya, pada hakikatnya ingin menyampaikan mesej kepada Zambry dengan mesej berikut :-

a. Bahawa memandangkan kamu hanya memohon perintah deklarasi sahaja , kami ( para hakim ) hanya benarkan untuk kamu memohon perintah tersebut melalui kaedah Saman Pemula dan tidak melalui Semakan Kehakiman di bawah Perkara 53 Kaedah-Kaedah Mahkamah Tinggi 1980.

b. Tapi kamu juga kena faham apabila kamu hanya memohon perintah deklarasi sahaja dan tidak memohon perintah certiorari dan mandamus, kami boleh beri perintah yang kamu pohon tapi jangan salahkan kami kalau perintah tersebut tidak boleh membawa apa-apa kesan pemaksaan ( coercive force ) ke atas Sivakumar.

c. Kamu sendiri harus dipersalahkan kerana tidak memohon perintah certiorari dan mandamus bagi memastikan sebarang keputusan Sivakumar bukan sahaja dapat dibatalkan tetapi juga dapat dibuang/dipadam dari rekod DUN Perak. Tanpa perintah certiorari, keputusan Sivakumar tersebut akan kekal di dalam rekod di DUN Perak kerana kamu tidak pohon untuk padamkan perintah tersebut.

d. Kalau peguam kamu sendiri mengaku bahawa kamu tidak boleh pohon perintah certiorari dan mandamus bagi memadamkan keputusan Sivakumar, mengapa kamu masih juga memfailkan permohonan saman pemula ini dan meminta kami memerintahkan perintah yang tidak membawa apa-apa manfaat untuk mencabar keputusan Sivakumar.

e. Memandangkan kamu dah berada di Mahkamah ini dan memohon perintah-perintah deklarasi ( sebanyak 10 perintah ) kami bagi jugalah sebagai “saguhati” kepada kamu iaitu dua perintah deklarasi dari 10 perintah tersebut.

Sama ada mesej tersebut difahami oleh Umno atau tidak kita lihatlah pada 7 hb Mei ini .

Balik Ke Mahkamah Tinggi...Malaysiakini..

The Federal Court today sent back the ex-MB versus MB case to the Kuala Lumpur High Court after dismissing Perak Menteri Besar Zambry Abd Kadir’s application for a fastrack hearing.

The apex court allowed the preliminary objection raised by ousted menteri besar Mohd Nizar Jamaluddin's counsel Sulaiman Abdullah.

Justice Alauddin Mohd Sheriff agreed that disputed facts exist between the affidavits filed by Mohd Nizar and the state legal advisor, who is representing Zambry.

The judge said this has to be determined by the hight court. Zambry's application was dismissed based on the preliminary objection but not on merits.

Terpandang Ke depan

Saya mengira kalau Nizar menerima pencalonan dia akan menang dengan undi tertinggi. Nampaknya fenomena dalam hiburan turut berjangkit ke dalam politik, di mana orang popular mudah mendapat sokongan dan akan menguasai parti. Apa yang berlaku ke atas Asmawi Ani (Mawi) akan berlaku ke atas Nizar Jamaluddin. Kalau kerajaan Kelantan juga terliur mengundang Mawi apa lagi dengan ahli bawahan yang muda nampak kepada objek-objek yang aneh dan mudah memantulkan cahaya.

Tetapi apakah ada yang sedar di sebalik kehebatan Nizar ini bahawa cara Nizar itu tidak ubah seperti Pak Kadok yang menang sorak kampung tergadai? Nizar menjadi pujaan tetapi kuasa hilang! Nizar disokong oleh rakyat namun jawatan tidak ada? Inilah perkara yang perlu ahli Pas khasnya kena menilai dan merenungi ke atas tindak tanduk Nizar.

Nik Abduh: Politikus muda...

kerja - kerja bodoh dalam pas

Begitulah tajuk terbaru posting Nik Abduh, putera TGNA...

Teman tak tau apa yang membuatkan beliau untuk menulis panjang lebar sebegitu...seolah2 serious benar peranan yang dimainkan oleh orang keliling TGNA yang boleh mencetuskan perang besar antara Tuan Presiden dengan Murshidul Am PAS. Seolah2 ada dua puak dalam PAS sekarang...

Macamlah Unity Government idea TGHH telah digagalkan gara2 angkara orang keliling ayahanda beliau semata2... yang telah memperalatkan TGNA untuk reject idea Tuan Presiden itu.

Temanpun tak faham kenapa setengah2 golongan dalam PAS ni begitu obsessive dengan idea Unity Government ni.? Tuan Guru Presiden sendiri (dengan jiwa besar beliau) telah menyatakan apakah sebab2 idea Unity Government ini telah ditarik balik dan sebagai pengikut atau pemimpin kecil, wajar sekalilah kita wala' dengan keputusan Tuan Presiden kita. Apakah kita pula mahu menjadi pencacai Tuan Presiden...sedangkan kita meluat dengan pencacai TGNA? 2x5=5x2....

Yang paling teman tak gemor ialah...apa ke hei tuduhan sebegitu rupa dilemparkan secara terbuka? Bijak sangatkah jalan yang dipilih oleh Nik Abduh ini? Apakah inipun boleh kita golongkan dalam tajuk posting beliau itu sendiri...kerja-kerja bodoh orang pas? Menggali kubur sendiri.!!

Sebagai parti yang berdisiplin dan patuh kepada keputusan berjemaah...amatlah wajar kritikan sebegini dilakukan di dalam mesyuarat2 di peringkat Pusat secara tertutup. Kalau mahu dilakukan secara terbuka, mungkin di dalam Muktamar yang bakal diadakan tidak lama lagi umpamanya supaya pihak yang dituduh boleh menjawab tuduhan yang dilemparkan. Lebih2 lagilah Nik Abduh juga turut terlibat di dalam beberapa mesyuarat di peringkat pemuda.

Teman menyanjung tinggi Nik Abduh sebagai pemimpin muda yang punya masa depan yang cerah dalam arena politik negara. Sementelahan pula beliau adalah putera TGNA yang sudah tentu telah menjalani proses tarbiyah sejak sekian lama direct dari ayahanda beliau sendiri.

Kita mesti ingat bahawa PAS sekarang ini mula diterima oleh berbagai kelompok, peringkat, kaum dan sebagainya. Oleh itu kita perlu bersedia untuk menjadi wadah kepada perjuangan yang universal sifatnya. Perbezaan pandangan perlulah kita hadapi dengan penuh hikmah dan sabar. Memberi kata dua kepada satu golongan yang sedikit berbeza dengan fikrah kita ditakuti bukanlah satu approach yang paling sesuai dan bijak.

Lebih menyayat hati, kritikan sebegini seolah2 secara tidak langsung telah merendahkan kebijaksanaan TGNA sendiri. TGNA boleh ada 100o penasihat dan 1000 pencacai di sekeliling beliau tetapi teman percaya TGNA terlalu bijak untuk dipesongkan. He was his own man... with guidance from Allah. Wallahu'alam...

Akhirnya tersungkok juga SPR...tak daye dah...terpaksa juga adakan PRK di Penanti.

Penanti vote is on

PUTRAJAYA, April 27 — The Election Commission (EC) today finally set May 31 as polling day for the Penanti state by-election in Penang.

Nomination day is set for May 23.

The announcement today ended days of intense speculation that the EC might reject the vacancy notification from the Penang assembly speaker, after former Penang Deputy Chief Minister Mohammad Fairus Khairuddin resigned on April 16.

The EC was supposed to reveal the dates three days ago but decided to delay it, resulting in the opposition questioning it’s independence but the commission said the postponement was caused by unresolved administrative matters.

The Penanti by-election is the sixth since the general election last year and was described by Umno president Datuk Seri Najib Razak as a waste of public funds and the Prime Minister had indicated that Barisan Nasional (BN) could skip the contest.

In the general election last March, Fairus defeated Permatang Pauh Umno division chief Datuk Abdul Jalil Majid by 2,219 votes.

In 2004, Jalil won the Penang state seat by 667 votes.

"He will also meet the relevant authorities (like the Perak Islamic Affairs Department) to settle this in accordance with the cabinet decision."

"We expect the minister (Jamil) to return the children to their mother."

Begitulah nasib orang agama dalam kabinet Barisan Nasional. Apa nak buat yob...jadi kuda kayu ajelah. Dulu baca ni baca talqin.

KUALA LUMPUR, April 25 — B. Balendran is just like any other devout Hindu who celebrates Deepavali and does not eat beef. But in his free time, he attends political rallies by PAS and helps to recruit new members for its Supporters' Club.

And he actively campaigned for the conservative Islamic party during last year's general election.

The 25-year-old engineer has roped in two of his sisters and several friends to join what he says is the best party to govern Malaysia.

Balendran's view: “If PAS takes over Malaysia, I will be very happy because there will be no more corruption and Malaysia will be in a good situation.”

The PAS Supporters' Club for non-Muslims was founded in 2004 with just 100 members, said its founder, Hu Pang Chow.

Its membership was at 10,000 last year, but has surged to 50,000 since the opposition made big gains in the general election and PAS joined the Pakatan Rakyat opposition alliance, he said.
Unlike ordinary party members, those who join the Supporters' Club become associate PAS members and cannot vote in office bearers.

So why do non-Muslims opt for PAS, instead of the secular DAP or the multi-racial Parti Keadilan Rakyat (PKR)?

Hu said those who join the club see PAS as “being the most principled and sincere”. The bulk of the members are ethnic Indians.

Some members are avoiding PKR, which is seen by some Indians as not being strong in supporting Indian issues. And some Indians feel that DAP is too Chinese-centric.

Said N. Balasubramaniam, chairman of the Indian chapter of the club: “DAP and PKR have their own rules, but whether they follow them or not is up to them.”

He said it is different for PAS, which has to strictly follow Islamic teachings.

PAS has always been demonised by ruling Barisan Nasional coalition leaders as the party that will implement its strict version of Islam in Malaysia.

But Balendran said he is not worried about the PAS aim of setting up an Islamic state or implementing syariah laws — including hudud, which prescribes amputation and stoning — because he says such laws would apply only to Muslims.

The increasing acceptance of PAS by non-Muslims was displayed during the general election in March last year when Kumutha Rahman ran for the party. She contested under the PKR flag as the PAS constitution does not allow non-Muslims to run on its ticket.

Although she lost, her candidacy was seen as a breakthrough for both the Islamic party and the Indian community.

And during that election campaign, non-Muslim Indians and Chinese were openly waving the flag of the Islamic party and helping in door-to-door canvassing.

To be sure, part of the enthusiasm to join a political party by the Indians was a follow-up from the mammoth rally organised by the Hindu Rights Action Force in November 2007, which was met with police water cannon and tear gas.

Many of the party-less Indians opted for the opposition parties after losing hope in the MIC led by the unpopular Datuk Seri S. Samy Vellu.

The steady 18-year rule by PAS of Kelantan has also boosted trust among some non-Muslims, said Hu.

Social scientist Sivamurugan Pandian of Universiti Sains Malaysia also credits PAS's religious credentials for its popularity.

“It has religion as its backbone and the perception is that it is more sincere and will be able to uphold equality and the welfare of the people,” he said.

PAS has also toned down its rhetoric on an Islamic state with the emergence of more moderate-minded young leaders.

“It will become an alternative on its own in the future if Pakatan Rakyat fails to maintain its coalition with PKR and DAP,” he told The Straits Times.

PAS is now working towards setting up a full-member wing for non-Muslims within the party.
This is expected to happen by next year, pending approval from its central chiefs and an amendment to the party constitution.

“PAS leaders now realise, in this multiracial community, that they cannot survive alone. They need the support of the non-Malays, or else there is no way for them to win,” said Hu.

Apa lagi yob? Zaid kata anytime..anywhere..any subject. Jangan buat helah pulak ye...tak kan nak suruh Masnah urut kaki Big Mama...tumpo yob!!

Zaid: I will debate Rais on any subject, anytime and anywhere

KUALA LUMPUR, April 24 - Former de facto Law Minister Datuk Zaid Ibrahim has picked up the gauntlet thrown down by Datuk Seri Rais Yatim today and says that he is ready to debate the new Minister of Information, Communication and Culture.

The maverick politician's only conditions are that Rais has to specify exactly what he wants to debate and that it has to be televised.

"Yes, I will debate Rais on any subject he wants, anytime and anywhere," Zaid told The Malaysian Insider.

"But RTM must show it otherwise it is a waste of time."

Bernama today reported that Rais challenged Zaid to a public debate over his allegations against Najib, as the former minister has been often quoted in the foreign media.

Rais also accused the foreign media of trying to topple prime minister Datuk Seri Najib Razak.

"However, we must study (the situation) and if I have the chance, I want to have a debate with those trying to implicate our leader with unbecoming and nonsensical words," Rais said.

The veteran minister has been reported as blaming the media for various troubles that plague Umno and the Barisan Nasional ever since he was appointed to his current portfolio earlier this month.

Zaid quit the government and Umno last year over disagreements on political reforms. He remains an independent politician but is expected to join an opposition party.

Selain dari ingin mengucapkan tahniah kepada Fairus, teman merasakan amatlah wajar pihak2 yang melemparkan berbagai tohmahan dan fitnah kepada Fairus untuk bermuhasabah diri. Jika Fairus incapable...itu cerita lain. Benda2 yang beliau tak buat tidak perlulah diada2kan... Budaya UMNO kena buang jauh2 yob!!

Tunku Aziz (DAP's Deputy Chairman) also questioned Najib's 'One Malaysia' concept and pointed out that the proposal was not something new as DAP had long touted for a "Malaysian's Malaysia".

He said for the 'One Malaysia' concept to be successful, race-based policies must be terminated.

APRIL 24 — “Wa respek sama lu!”. Sesekali bahasa rojak dapat menggambarkan sesuatu keadaan itu lebih mencengkam berbanding dengan bahasa standard. Walaupun saya pejuang bahasa standard dan tidak suka menggunakan bahasa rojak tetapi sesekali saya berasa puas dapat ungkapkan bahasa rojak untuk saya sampaikan hasrat saya kepada orang-orang tertentu. Jangan salah faham, saya tidak maksudkan orang tertentu dengan gaya bahasa sedemikian dimaksudkan untuk geng “Mat Rempit” atau “minah-minah gedik” tapi saya tujukan ungkapan rojak ini kepada Ah Tek, Ong, Bak Chua, Ah Hin dll dari Kelab Penyokong PAS Parit Buntar.

Bukanlah saya tak pandai nak ungkapkan kata yang lebih baik, tetapi itulah bahasa yang difahami oleh “Ah Tek and the gang”, dan tulisan saya ini saya dedikasikan kepada mereka daripada aktivis Kelab Penyokong PAS Parit Buntar yang telah menunjukkan komitmen mereka memenangkan PAS di Bukit Gantang. Saya yakin ramai lagi seumpama Ah Tek dan rakan-rakannya dari merata cerok yang “pulun habih”untuk PAS antaranya Ah Beh Bagan Serai. Tidak ketinggalan Suria, Nali, Siva dll, mereka habiskan tenaga dan wang ringgit untuk memastikan kemenangan berpihak kepada PAS dan Pakatan Rakyat. Kepada mereka , “wa mau kasi tau, memanglah wa respek sama lu olang”.

Pagi itu saya terima SMS daripada Abang Hamdan yang merupakan Pegawai Khas Perpaduan di Pusat Khidmat Parit Buntar. Berita pagi itu memang memeranjatkan kerana ia adalah pemberitahuan tentang pemergian sahabat baik saya Haji Roslan Shahrum, Ahli Parlimen Buki Gantang. Saya menelefon nombor YB Roslan sendiri yang hingga hari ini masih tersimpan dalam senarai nombor talipon bimbit saya, lalu dijawab oleh anak allahyarham yang dengan nada sebak mensahkan apa yang saya terima daripada SMS. Kemudian untuk maklumat selajutnya saya menghubungi Wan, Pegawai Khas YB, lalu saya diminta oleh Wan bagi memudahkan urusan post-mortem untuk membekalkan kepada pihak hospital di Batu Gajah surat pengesahan bahawa YB Bukit Gantang itu telah jatuh di Taiwan dan disahkan ada masalah jantung di hospital Taiwan. Untuk pengetahun, saya , YB Padang Terap dan YB Nibong Tebal bersama YB Roslan menghadiri Konfrensi Keamanan di Taiwan dan semasa itulah YB Roslan ketika menaiki tangga jatuh dan pengsan lalu dikejarkan ke hospital. Jadi pengesahan kami adalah penting dan alhamdilillah segala urusan post-mortem dan pengebumian berjalan dengan lancar (akan saya dedikasikan kisah YB Roslan dalam tulisan yang lain).

Berita YB Roslan disambut dengan dua perasaan, pertama sedih dengan pemergian seorang sahabat seperjuangan, kedua kagum kerana pemergiannya seolah menjadi mercu tanda keperwiraan menebus maruah negeri yang telah dirampas oleh BN secara tidak demokratik. Saya kata wira kerana keengganan SPR membubarkan tiga DUN yang belot telah digantikan dengan pembubaran wajib Bukit Gantang dengan pemergian YB Roslan yang “berkorban nyawa” demi maruah ini! Berita PRK yang akan dibuat pada 7 April dan penamaan pada 29 March sudah diketahui dan SPR mengambil had masa yang maksima iaitu 60 hari, agaknya kerana ingin memberi laluan kepada Perhimpunan Agung Umno yang berakhir pada 28 March.

Setelah “memanaskan badan” di dataran Sungai Kerian, Parit Buntar, rutin saya ialah sarapan dengan rakyat di mana-mana gerai yang saya rasa perlu. Pagi itu Abang Hamdan mengajak saya makan pagi di pekan Kuala Kurau sekaligus berjumpa dengan Ah Tek dan Ong kerana mereka ingin tahu perkembangan PRK Bukit Gantang. Selesai berjoging pagi itu saya dan Abang Hamdan bersarapan di bangunan Mara Kuala Kurau besama YB Yunus, ADUN Kuala Kurau dan pembantunya Nan. Ah Tek dan Ong turut serta,lalu sambil makan pagi, Ah Tek dengan nada semangat berkata: “Ini kali lu jangan bimbang, kita mesti menang punya, olang lamai pun cakap ini macam PAS mesti angkat punya!” Saya pun terangsang dengan kata semangat Ah Tek yang hanya beseluar pendek dan memakai T- shirt lusuh PAS yang kurang dua tiga batang gigi hadapan. Dia terus merangsang kami yang terpegun dengan kata-kata motivasinya: “Ini PAS apa jadi pun talak lari ohh, PAS punya olang banyak kuat, itu olang Cina kata aa.. bo chow ohh…. Ehh YB kita jalan-jalan nanti jumpa sama olang ahh, ini satu pekan saya kenai semua olang, dia olang banyak syiok oo kalau YB pi salam-salam sama dia olang...”

Saya dah agak dah, Ah Tek ni memanglah suka bawa saya bersalaman dengan orang ramai di kedai-kedai kopi Cina, sambil kembang hidungnya memperkenalkan YB dia kat orang ramai dan memang pun orang Cina di Kuala Kurau memberi sokongan padu kepada PAS dalam PRU baru-baru ini. Kami pun meninggalkan bangunan Mara untuk berjalan-jalan di pekan Kuala Kurau sambil salam dengan semua orang dan setiap kali bersalaman baik dengan orang Melayu ataupun Cina mereka menenangkan kami sambil berkata: “Jangan takut mesti menang punya!” Begitulah suasana sebelum PRK Bukit Gantang, belum pun loceng berbunyi sudahpun diberi sokongan moral untuk PAS. Di pintu kereta, Ah Tek ucap selamat tinggal sambil berjanji akan turun Bukit Gantang dan akan berkempen habis-habisan.

Pada hari penamaan calon ramai daripada ahli Cina Kelab Parit Buntar tidak hadir kerana ada hari keagamaan bersih kubur. Kecuali Bak Chua dari Tanjung Piandang, Ong, Ah Tek dan Ah Be Bagan Serai minta maaf kepada saya tidak dapat hadir, saya memahaminya bagi menghormati mereka. Tetapi selepas penamaan calon hampir setiap hari mereka turun untuk memastikan calon PAS menang. Mereka pusing merata ceruk yang ada pengundi-pengundi Cina untuk edar risalah dan berkempen dari rumah ke rumah. Kehadiran mereka mewarnai slogan “PAS for All”, ia bukan retorik macam “1 Malaysia” tetapi sesuatu yang real, bukan sahaja PAS menawarkan manifesto politiknya untuk semua tetapi semua kaum di negara ini bekerja untuk memenangkan PAS melalui aktiviti kempen mereka. Bagi saya inilah yang menakjubkan. Mereka juga berbangga memakai baju “PAS For All”, topi yang ada gambar Tok Guru dan badge lambang PAS. Mana-mana mereka pergi sedikitpun mereka tak berasa kekok dengan T-Shirt Kelab Penyokong PAS Perak yang tertera slogan keramat “PAS for All”. Bak Chua yang paling bersemangat, kampong Melayu pun dia mahu berkempen.

Dalam salah satu hari berkempen saya ajak mereka minum dan makan sebagai penghargaan saya kepada mereka kerana sepanjang waktu berkempen saya hanya membekalkan duit minyak sahaja kepada mereka, sudah tentulah tidak mencukupi, jadi dengan belanja mereka makan sekurang-kurangnya terubat rasa letih mereka. Sambil menikmati tom yam di bandar Taiping, Bak Chua melahirkan kebimbangannya: “Wa atak takut Cina punyi undi, dia mesti kasi sama koyok (PAS) punya, itu Melayu aa wa ada takut sikit, dia olang mau sama Umno lagi” dalam kebimbangan itu sempat dia memotivasikan saya, Abang Hamdan, Azizi, Jas, dll: “Tak pa maa... mesti mau kerja kuat sikit, mesti menang punya lu jangan takut!” Saya kagum dengan semangat ini, saya sering termenung memikirkan ungkapan-ungkapan ini dari mulut seorang Cina ahli kelab yang bahasa Melayunya tunggang terbalik dan pada waktu yang sama saya berasa terharu terhadap perjuangan Islam PAS di Malaysia yang menyerlahkan lagi kebenaran Tuhan merestui perjuangan ini. Bayangkanlah dalam kepekatan perkauman, PAS muncul memecahkan tembok ini dan dibuktikan dengan gerakkerja Kelab Penyokong yang bersama memecahkan tembok ini. Bagi saya ahli kelab yang bertebaran di seluruh negara hari ini adalah wira-wira yang memecahkan tembok perkauman ini, membelah arus dan mengambil risiko yang tinggi.

Saya insaf kerana berkat perjuangan politik Islam PAS, Allah menzahirkan hujjahnya kepada manusia bahawa jika kamu orang Islam menolak perjuangan Islam aku jadikan yang bukan Islam mendokong perjuangan Islam! Mereka hanya beberapa inci sahaja mencapai nikmat keadilan yang diperjuangkan oleh PAS, hanya hidayah Allah yang menjadi penentunya untuk beberapa inci lagi! Ah Tek menyumbangkan 200 kotak mineral walaupun dia hanya menggoreng kueh tiaw sahaja di pekan Kuala Kurau. Ong agak lanjut usianya, ada masalah jantung walaupun tak serik menghisap rokok lagi. Ong termengah-mengah berjalan dalam suaranya yang lembut sedikit menyeru kaumnya menyokong perjuangan PAS, ada seketika dia terpaksa berhenti duduk kerana letih, mukanya sedikit pun tak menunjukkan kesal kerana terpaksa begini untuk menangkan PAS. Satu sen pun dia tak mintak kepada PAS, dia hanya mahu diperhatikan dan didorong, cukuplah itu “habuannya” dalam menjadi ahli Kelab Penyokong PAS. Saya pelik sesekali bila terkenangkan orang PAS sendiri yang meminta-minta habuannya, kononnya telah bertungkus lumus untuk parti. Saya malu dalam diam kepada Ong, Ah Tek dan Bak Chua apabila mengenangkan ada orang PAS yang “demanding” dengan parti tentang kos, dll. Ingat, mereka ahli-ahli kelab adalah hujjah untuk kita dan juga keatas kita.

Saya tahu selain watak AhTek, Ong, Bak Chua, Ah Hin, Ah Beh ada lagi wira-wira yang saya tidak tahu nama mereka. Mereka mungkin ada di kawasan-kawasan lain, yang penting belailah mereka, bimbinglah mereka dan ambil berat kebajikan mereka. PAS memerlukan ramai lagi seperti “Ah Tek and the gang” kepada wakil-wakil rakyat PAS, jangan sia-siakan pengorbanan ahli kelab dan jangan mengadu hal tentang mereka tetapi cari jalan untuk menjinakkan mereka menjadi aktivis parti yang berkesan dengan hikmah. Tapi buat masa ini, kisah ringkas watak-watak dalam Parit Buntar ini yang telah membuktikan kesetiaan mereka di Bukit Gantang saya ingin rakamkan pada akhir kalam ini: “Wa respek sama lu!”

Menurut ustaz...para hakim, para pengamal undang-undang dan penguasa serta pegawai2nya perlulah meneliti, menghayati dan seterusnya mengamalkan wahyu yang diturunkan oleh Yang Maha Berkuasa untuk dijadikan landasan atas segala tindakan bakal dilakukan.

Tiada manusia yang akan lepas dari janji Allah seperti mana yang dijanjikanNya di dalam ayat ini, "MAKA SESUNGGUHNYA ALLAH ADALAH MAHA MENGETAHUI AKAN SEGALA APA YANG KAMU KERJAKAN."

Pelik sungguh manusia ni...apakah mereka fikir kehidupan ini tiada pengakhirannya? Adakah menggadaikan maruah semata2 untuk mendapat recognition dan mengejar pangkat adalah segala2nya?

Hikayat PRK Penanti seperti ada cerita di sebalik tabir yang ramai orang sedia menawarkan diri untuk memainkan peranan. What a joke.
Sudah muak kita tengok tingkah laku penjawat awam yang sedia diperkudakan oleh BN... dan episod ini tidak akan berakhir selagi mereka tidak kembali kepada jalan yang Allah dan RasulNya tetapkan. Wallahu 'alam...

Pasir Mas parliamentarian Datuk Ibrahim Ali as saying that the total number of seats in Parliament occupied by Malay Malaysians was enough to form government. Therefore, the government should fulfil all the wishes of Malay Malaysians because they were the majority, and not keep on co-operating with non-Malay Malaysians.

Ibrahim Ali Ibrahim went on to urge Umno to return to a hardline position. “Malay parties are strong when Malay [Malaysians] are taken care of. So Umno has to focus on Malay [Malaysians]. Umno doesn’t need to fear because I see that when Umno is strong, non-Malay [Malaysians] will automatically support the Barisan Nasional (BN), as before,” he said.

Maka tertengoklah teman TV2...cerita The General's Daughter (1999)...Hmm plot cerita agak menarik. Filem ini dibarisi oleh pelakun2 hebat Hollywood...antaranya ialah John Travolta, Medeleine Stowe, James Cromwell dan James Woods...

Kisah berkisar kepada anak LTG Campbell yang dikhianati oleh key words nya ialah betrayal...khianat.

Makna betrayal yang dipetik dari wikipedia ialah... a form of deception or dismissal of prior presumptions, is the breaking or violation of a presumptive social contract (trust, or confidence) that produces moral and psychological conflict within a relationship amongst individuals, between organizations or between individuals and organizations. Often betrayal is the act of supporting a rival group, or it is a complete break from previously decided upon or presumed norms by one party from the others. Someone who betrays others is commonly called a traitor or betrayer. Betrayal is also a commonly used literary element and is often associated with or used as a plot twist.

The General's Daughter ialah sekadar satu cerita rekaan semata2 tetapi drama sebenar kisah betrayal ini dapat kita lihat di negara kita. Di segenap sudut.

Pemimpin yang khianat dengan amanah rakyat.

Hakim yang khianat dengan perlembagaan dan undang2 negara.

Pemimpin badan2 kerajaan yang khianat dengan amanah yang datang dengan jawatan yang disandang.

Bukit Indah Sudah Tidak Selamat...

Minggu lepas Pusat Tuisyen Sri Mawar Bestari kena samun...

Khabonye beberapa orang guru dan kakitangan pusat tuisyen tersebut telah diugut dengan piasau dan sebagainye...

Semalam pulak keluar dalam Harian Metro kisah 40 samseng mengamuk jam 6 pagi di kedai makan hindu tu...yang tak berapa jauh dari Balai Polis Bukit Indah. Apa dah jadi ni yob?

Teman nak cadangkan begini....

Selain dari rondaan biasa dipertingkatkan...kedai2 makan di sekitar Bukit Indah ni patutlah diwajibkan tutup jam 12.00 malam.

Tak payahlah ada apa-apa perniagaan selepas jam 12.00 malam kecuali klinik.

Ibu bapa boleh tumpukan masa di rumah bersama keluarga sementara anak-anak pula taulah dunia ni ada waktu siang dan ada waktu malamnya. Ada waktu berjaga ada waktu tidur...

Selaras dengan saranan Fomca agar institusi keluarga diutamakan..Turn off TV for a week to enhance family values and ties, teman rasa adalah amat wajar MPAJ dan kerajaan negeri melihat ini secara serius.

Di kebanyakan negara maju...kedai2 ditutup awal.

Nak buat maksiat pergilah keluar dari Ampang...keluar dari selangor.

Duit komisyen dah habis kot?

Bila orang tu tak nak berhenti sibuk dia suruh berhenti...kan giler orang Umno ni... Tengok apa Khir Toyo cakap pasal Elizabeth Wong pulak...

Semalam pulak di muka depan paper The Star...terpampang kos perbelanjaan 5 pilihanraya kecil lalu ... Cuba perhati betul2... perbelanjaan sapa yang banyak?

Hmm..!! RM31 juta sahaja untuk perbelanjaan polis. Sedangkan perbelanjaan SPR cuma RM500 ribu satu tempat. Yang hantar polis ramai2 tu nak buat apa? Excessive tak tentu pasal.... sapa suruh...

Yang sebenonye dia orang tau harapan nak menang...macam kira tak ade lah...Dalam Fairus tu cuma menang 2,219 undi sahaja...Tapi masa PRK Permatang Pauh baru2 ni...DSAI dapat majoriti lebih 3,825 undi di Penanti...

Perak crisis: Judges have let Najib down

The Federal Court decision that Perak speaker V Sivakumar did not have the right to suspend BN Menteri Besar Zambry Abd Kadir and his six cabinet members is a perverse judgment.

MCPXIt is perverse because it is a decision that was made in blatant defiance of Article 72 (1) of the Federal Constitution which says, "The validity of any proceedings in the Legislative Assembly of any State shall not be questioned in any court".

The judges of the Federal Court have failed the people and the government of this country when they chose to ignore the law of the Constitution of Malaysia. In other words, the judges have refused to do justice according to law.

Incidentally, ultra vires does not mean "outside the law". It means "outside one's jurisdiction, beyond the scope of one's power or authority".

And we may ask, who is the Federal Court to say what is beyond the jurisdiction of the speaker when the supreme law of the country says that "the validity of any proceedngs in the Legislative Assembly of any State shall not be questioned in any court".

Don't these judges realise that they have actually done a disservice to the government of the day? Perhaps they have never heard of the Taff Vale case.

In 1900, the English House of Lords, which is the highest court in the land just as our Federal Court is the highest court in this country, handed down an outrageous decision which was unpopular to the common people of England.

Voters threw out gov’t after judges erred

The judges of the House of Lords by their judgment had unwittingly done a great disservice to the Conservative government of the day because in the general election of 1906, it was toppled by a landslide.

The case which was the cause of the fall of the Conservative government was Taff Vale Rly Co v Amalgamated Society of Railway Servants.

It is best that I let Lord Denning take up the story from his book ‘Landmarks in the Law’:

“There was the great Taff Vale case. To understand it, you must know that the trade unions were virtually friendly societies. The members paid their subscriptions into a fund, out of which benefits could be paid to members if they were ill or out of employment.

“Now in the Taff Vale case, the railwaymen's union called a strike at the railway station at Cardiff. The men left work and set up peaceful pickets so as to persuade others not to go to work. The trains could not run, and the company lost money. The railway were advised to bring an action against the union itself, seeking an injunction and damages. The Court of Appeal threw out the action.

“But the House of Lords, in a startling judgment, overruled the Court of Appeal. They issued an interlocutory injunction against the trade union itself, restraining it from setting up the pickets, and said that the railway company could recover damages which could be enforced against trade union funds.

“Later, at the trial itself, the damages were assessed at £23,000 and that sum was paid out of the funds of the trade union. £23,000 in 1900. What would that be now?

“In the eyes of trade unions, that was an outrageous decision. It meant that the railway company could take all the funds subscribed by the members so as to meet the damages. It meant that, in future, a trade union could never call a strike, else it would be in peril of losing all its funds. It meant virtually the end of trade unions. As GM Trevelyan says in his History: 'It struck at the very heart of trade union action'.

“That case had immense political consequences. At the general election of 1906, there came into being a new political party. It was the Labour party. They ran a host of candidates themselves. They pledged complete immunity for trade unions. Many of the Liberal candidates gave the same pledge.

“The result of the general election was like an earthquake. Liberals had 397 seats. The new Labour party had 50 seats. The Conservatives only 157. It was a sweeping victory for the trade unions.

“Parliament immediately passed the Trade Disputes Act 1906. It is probably the most important Act ever put into the Statute Book. It reversed all the judicial decisions against trade unions. The Taff Vale case was overruled. No trade union could thereafter be sued for damages for any wrongs done by its members. Its funds were unassailable."

I think the message of the Taff Vale case to our judges of the Federal Court should be clear enough. The electorate may decide, just as the voters did in 1906 England to throw out the Conservative government, to use the power of their vote to unseat the BN government in the next general election because they do not trust the judges.

What if speaker ignore court decision?

Poor Najib Abdul Razak, our new prime minister, it is the judges who have let him down. Unfortunately it would be the prime minister who has to carry the baby, but not the irresponsible judges who did all the damage by not administering justice according to law.

The law, in the present context, is the Federal Constitution, in particular, Article 72 which states:

(1) The validity of any proceedings in the Legislative Assembly of any State shall not be questioned in any court.

(2) No person shall be liable to any proceedings in any court in respect of anything said or any vote given by him when taking part in proceedings of the Legislative Assembly of any State or of any committee thereof.

(3) No person shall be liable to any proceedings in any court in respect of anything published by or under the authority of the Legislative Assembly of any State.

Suppose Sivakumar were to ignore the declarative decree of the Federal Court, what then?

Clause (2) of Article 72 of the Federal Constitution says that "No person shall be liable to any proceedings in any court in respect of anything said or any vote given by him when taking part in proceedings of the Legislative Assembly of any State or of any committee thereof'.

The Federal Court can say anything they like but the speaker is not liable to any proceedings in any court in respect of anything said or any vote given by him when taking part in proceedings of the legislative assembly.

The order of the Federal Court seems to me to be a ‘brutum fulmen’, which in Latin means "ineffectual thunderbolt” - an action which is loud but ineffective.

Zambry dan enam Adun BN tidak boleh hadiri sidang Dun Perak

Tentu ramai yang ingin tahu kesan keputusan Mahkamah Persekutuan kelmarin, yang memutuskan bahawa tindakan V.Sivakumar, Speaker DUN Perak menggantung dan melarang Zambry ak dan enam exconya hadir di Dun Perak selama 18 bulan dan 12 bulan adalah terbatal dan tak sah.

Benar terbatal, jika dilihat kenyataan peguam Umno dan akhbar kongkongan Umno yang melaporkan bahawa Zambry dan enam exconya kini dibenarkan menghadiri sidang Dun Perak.

Sidang Dun dijadual diadakan pada 7 Mei ?

Sesungguhnya banyak yang tidak dilaporkan dan fakta disembunyikan dan tidak jelaskan. Mahkamah hanya membenarkan dua (2) daripada 10 perintah yang dipohon Zambry iaitu: Pertama, perintah membatalkan keputusan V. Sivakumar yang menggantung dan melarang Zambry hadir di Dun Perak selama 18 bulan.Kedua, membatalkan keputusan V. Sivakumar menggantung dan melarang enam exco Zambry hadii sidang Dun Perak sah.

Lapan permohonan Zambry tidak dilulus ?

Apa sahaja kenyataan peguam Umno bukanlah perintah Mahkamah, tetapi sebaliknya adalah kenyataan mereka yang tidak berasas. Meskipun peguam Umno berhempas pulas dan bermati-matian berhujah, Mahkamah Persekutuan TIDAK MEMBENARKAN lapan lagi perintah berikut:

1. Perintah untuk Mahkamah mengisytiharkan bahawa keputusan Sivakumar (defendan pertama di dalam kes tersebut) menggantung dan melarang Plaintif Pertama (Zambry) menghadiri pada sidang Dun selama 18 bulan adalah ultra vires (bertentangan) dengan Undang-Undang Tubuh Negeri Perak, Perintah-Perintah Tetap Dewan Perhimpunan Undang Negeri Perak (standing orders) dan Enakmen Dewan Perhimpunan Undangan (Keistimewaan) 1959 dan/atau undang-undang yang berkaitan dan oleh itu adalah terbatal dan tak sah.

2. Perintah untuk Mahkamah mengisytiharkan bahawa perbuatan Sivakumar menggantung dan melarang Zambry menghadiri sidang DUN selama 18 bulan adalah menyalahi undang-undang.

3. Perintah untuk Mahkamah mengisytiharkan bahawa keputusan Sivakumar menggantung dan melarang Plaintif ke-2 hingga Plaintif ke-7 (enam Exco) menghadiri sidang Dun selama 12 bulan adalah ultra vires (bertentangan) dengan Undang-Undang Tubuh Negeri Perak, Perintah-Perintah Tetap Dewan Perhimpunan Undang Negeri Perak (standing orders) dan Enakmen Dewan Perhimpunan Undangan (Keistimewaan) 1959 dan/atau undang-undang yang berkaitan dan oleh itu adalah terbatal dan tak sah.

4. Perintah untuk Mahkamah mengisytiharkan bahawa perbuatan Sivakumar menggantung dan melarang enam Exco menghadiri sidang Dun selama 12 bulan adalah menyalahi undang-undang.

5. Perintah untuk Mahkamah mengisytiharkan bahawa Zambry dan enam Exconya adalah berhak menghadiri dan mengambil bahagian dalam semua sidang Dun dan menjalankan segala fungsi dan kewajipan mereka di dalamnya.

6. Perintah untuk Mahkamah mengisytiharkan bahawa Dun Perak adalah tidak terikat dengan keputusan Sivakumar menggantung dan melarang Zambry dan enam Exconya menghadiri sidang Dun Perak.

7. Perintah untuk mengisytiharkan bahawa Dun Perak adalah tidak terikat dengan apa-apa arahan, perintah dan/atau petunjuk Sivakumar yang berbangkit daripada atau berhubung dengan keputusan Sivakumar yang bertarikh 18.2.2009.

8. Perintah-perintah, perisytiharan dan/atau relif lain yang difikir suaimanfaat oleh Mahkamah.
Tegasnya, lapan perintah di atas yang Zambry dan enam exconya pohon TIDAK DIBENARKAN oleh Mahkamah Persekutuan.

Atas dasar itu jika peguam Umno atau akhbar pro-Umno mengatakan bahawa Zambry dan enam exconya boleh menghadiri sidang Dun Perak, jelas kenyataan itu bukan datang dari mana-mana perintah Mahkamah sebaliknya ia hanya kenyataan peguam Umno dan akhbar mereka.
Kenyataan tersebut tidak mempunyai apa-apa nilai di sisi undang-undang. Rakyat tidak perlu melayan kata-kata mereka yang dibuai khayalan tersebut.

Sivakumar masih Speaker. Zambry dan enam exconya mungkin tidak sedar atua sengaja tidak mahu sedar bahawa dia sedang melakukan satu kesalahan kerana mendedahkan dokumen-dokumen rasmi Dun Perak tanpa mendapat kebenaran terlebih dahulu dari Sivakumar sebagai Speaker, jika meneruskan usaha membawa kes ke mahkamah.

Itik dan ayam...

Sepagi ni teman kena melayan bizman dari Abu Dhabi....ini boss teman punya pasallah. Dia malas nak layan dia antor teman...

Penat cakap dengan orang arab ni. Dahlah teman tak gheti cakap arab...mamat ni tak gheti cakap orang putih. I wonder...kalulah dia orang ada pemimpin macam Che Det...(ada PPSMI).. tentu tak timbul masalah ni semua. Marah orang Gapena!! Gurau aje yob...

Dia datang Malaysia sebab nak cari sponser buat biz kat negeri dia. Pelik sungguh...selalunye orang kite yang kelam kabut nak cari sponser arab...sebab nak buat biz dalam negeri dema... berangan nak berniaga untalah...nak dapat duit mudah...Malaysian style.

Terkenang kawan teman dalam gomen. Ada satu projek tu banyak bebeno VOnye...maka marahlah dia kepada agensi kerajaan yang katenye patut dah masukkan budget semua dalam contract amount.

Maka jawab pegawai dari agensi kerajaan tu..mudah aje. Kite ni deal dengan Mat Salleh. Mat Salleh bukan macam orang Malaysia... semua boleh kow-tow. Dema semuanye contractual... Tak ikut kontrak boleh belahlah...tak kiralah mike tu KSN ke...KSU ke..Setpol ke?

Tu lah yob...nak cerite...rasa berlain sungguh biz di negara kite ni dengan negara lain. Kita biz know who bukan know how....!! Yelah...survival bizman kat Malaysia sekarang ni...semuanye kena kenal Mahajib...bukan Pak Lawak Lah lagi...

Sekali air bah, sekali pantai berubah...
